151RESOLUTION NO./5~I A RESOLUTION of the Council of the City of Moses Lake, Washington,retaining counsel for certain services in connection v/ith the issuance and sale of two issues of general obligation bonds of the city. JREAS,the City of Moses Lake is contemplating the rebuilding of the Alder Street causeway across Parker Horn and the building of two new causeways, one also across Parker Horn and the other across Pelican Horn, all of said causeways being within the boundaries of the city;and WHEREAS,in order to provide funds to pay the cost of such causeways and all necessary facilities therefor, the city is contemplating the issuance and sale of its unlimited tax levy general obligation bonds in the following sums for the followin •rposes: Alder Street causeway across Parker Horn,$200/' New causeways across Parker Horn and Pelican Horn,500,000; and WHEREAS,the Constitution and laws of the State of Washington require that the questions of whether or not said bonds may be issued for such purposes must be submitted to the qualified electors of the city for their ratification or rejection;and WHEREAS,it is deemed necessary and advisable that municipal bond counsel skilled in such matters be retained to draw the ordinances, resolutions,notices and other documents necessary for said election and the issuance and sale of said bonds,and to give their opinion as ^v> to the validity of said bonds at the time of their sale; NOW,THEREFORE,EE IT RESOLVED by the Council of the City of Moses Lake,Washington,as follows: That Preston,Thorgrimson &Horowitz,attorneys at law of Seattle,Washington,be and they hereby are retained to perform the services above set forth, and as compensation therefor the city agrees to pay them as follows: (a)For drawing all proceedings required for the election on said two bond propositions,DO (b)For proceedings for sale of bonds (1)If all of said bonds are authorized by the voters,and combined and sold in one issue,$350 (2)For Alder Street causeway bonds,200 (3)For new causeway bonds,250 (c)For opinions as to validity of said bonds (1)If said bonds are combined in one issue and one opinion is delivered,750 (2)On Alder Street causeway bonds,275 (3)On new causeway bonds,550 (d)For all out-of-pocket expenses,such as long distance telephone calls,which may be incurred in the performance of said services. In addition to the above, the city agrees to furnish said counsel at their office in Seattle, Washington,with a complete certi fied transcript of all proceedings taken in the matter of the issuance of said bonds.
