A RESOLUTION of the City of Moses Lake,Washington,
declaring the intention of the City Council to
improve a certain area in the city by the con
struction and installation of main and lateral
water lines and by doing all other work neces
sary in connection therewith and incidental
thereto,and fixing a time and date for the
hearing on this resolution.

BE IT RESOLVED by the City of Moses Lake,Washington,
as follows:
Section 1.That it is the intention of the City Council
of the City of Moses Lake,Washington,to order the improvement of
the area within the city bounded as follows:
All of that portion of the plat of Battery Orchard
Tracts lying southerly of the following described line,
and above elevation 1050 contour.
Beginning at the intersection of the northerly
boundary line of Tract 33 and the shoreline of Pelican
Horn,running thence northwesterly along the north
westerly boundary line of said Tract to a point on
the southeasterly boundary of Tract 51,which is half
way distance between the northeasterly and the south
westerly boundaries of Tract 51;
Thence continuing northwesterly on a line through
Tracts 51,55 and 67,mid-way between the northeasterly
and southwesterly boundaries to Tract 66;
Thence northerly along the easterly boundary of
Tract 66 to the northeast corner of said Tract;
Thence northwesterly along the northeasterly
boundary of said Tract to the northeast corner of
Tract 126;
Thence northwesterly along the northeast boundary
of Tract 126 to the shoreline of Parker Horn
by the construction and installation of the hereinafter described
main and lateral water lines together with all necessary valves,

hydrants,fittings and appurtenances for such improvements,and
by doing all work necessary in connection therewith:
An 8 inch water line connecting to an existing 8 inch
water line at the north comer of Tract 33,Plat of Battery
Orchard Tracts; thence southeasterly in and along Peninsula
Drive to Battery Road;thence by a 6 inch water line in and
along Peninsula Drive to Tana Drive;thence in and along
Tana Drive to Lakeshore Drive;thence in and along Lake-
shore Drive to Battery Road;thence by an 8 inch water line
in and along Lakeshore Drive to the northeasterly corner of
Tract 126, Plat of Battery Orchard Tracts.
A 6 inch line beginning at the intersection of Minona
Street and Peninsula Drive;thence in and along Minona Street
approximately 660 feet to the westerly boundary line of Tract
50,Plat of Battery Orchard Tracts.
A 6 inch line beginning at the intersection of Peninsula
Drive and Orchard Street;thence in and along Orchard Street
to Lakeside Drive;thence in and along Lakeside Drive to
Terminal Place;thence in and along Terminal Place to
Peninsula Drive.
Section 2.The estimated cost of the construction and
installation of the above described improvements and the doing of
all work necessary in connection therewith and incidental thereto
is hereby declared to be,as near as may be,the sum of $75,000,
and it is the intention of the City Council that approximately
$54,000 of such cost shall be borne by assessments levied in the
manner required by law upon the real properties benefited by the
proposed improvements and that approximately $21,000 of the cost
of such improvements be borne by the City of Moses Lake.
For the reason that the special benefits resulting from
the above described improvements extend beyond the property between
the termini of such improvements abutting upon,adjacent,vicinal
or proximate to the streets,drives,roads,avenues and other pub
lic ways proposed to be improved to a distance of ninety feet back
from the marginal lines thereof or to the center line of the blocks

facing or abutting thereon,whichever is greater,it is the
intention of the Council to create an enlarged local improvement
district to pay the cost of such improvements to be.borne by
assessments,or approximately $54,000.Approximately 67$of
such $54,000 shall be charged to the property lying between the
termini of the proposed improvement and extended back from the
marginal lines thereof to the middle of the block or one hundred
twenty feet on each side thereof,and approximately 33$of such
$54,000 shall be charged to the remainder of the property within
the enlarged district hereinbefore described.
Section 3. The city's engineers are hereby directed to
submit to the Council at or prior to the date fixed for the hear
ing on this resolution a statement of the estimated cost and ex
pense of such improvements,the portion thereof that should be
borne by the property within the enlarged district and the portion
thereof to be borne by the city, a statement in detail of the
local improvement district assessments outstanding and unpaid
against the property in this proposed local improvement district,
and the aggregate actual valuation of the real estate,including
25$of the actual valuation of the improvements in the proposed
district,according to the valuation last placed upon it for the
purposes of general taxation,together with a diagram or print
showing thereon the lots,tracts,parcels of land and other
property which will be specially benefited by said improvements
and the estimated amount of the cost and expense thereof to be
borne by each lot,tract,parcel of land or other property within
the proposed local improvement district.

Section 4. All persons who desire to be heard on the
question of the formation of such district are hereby notified
to appear at a meeting of the City Council to be held at
at o'clock .M.
Pacific Standard Time,on the day of ,1957,
which time and place are hereby fixed for the hearing of matters
relating to said proposed improvements and all objections thereto
and for determining the method of paying for said improvements.
The City Clerk and the city's engineers are hereby
directed to prepare and give notice of such hearing in the manner
required by law.
PASSED by the Council of the City of Moses Lake,
Washington,and approved by its Mayor at a regular meeting of
said Council held this 28th day of May,1957.
