258RESOLUTION NO.258 A RESOLUTION of the City Council of the City of Moses Lake,Washington,declaring its intention to construct and install water and sewer mains on Balsam Street and Garden Drive;to improve Balsam Street from Skyline Drive to 9th Avenue and Garden Drive from Hill Avenue to 9th Avenue,by grading,leveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement,the West half of Clover Drive and the East half of Grand Drive from North Terrace Addition to Hawthorne Drive, and the North half of Hawthorne Drive from Grand Drive to Clover Drive by grading,graveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement,Walnut Street from Chestnut Street to Pioneer Way by grading,gravel ing,constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement;to construct and install approximately 1250 feet of 8"sewer main with all necessary manholes beginning at the sewer lift station on Wheeler Road at Fig Street,thence Southwesterly through a portion of Assessor's Tax No.477-A and adjacent to Tax No.598 to Pioneer Way,thence Westerly across Pioneer Way to Walnut Street;thence Southwesterly along Walnut Street to the alley between Block 10 of Ritten- house Addition and Besselman Addition,thence Southeasterly along said alley to a point which is 225 feet from the center- line of Walnut Street;to improve Dogwood Street from "A" Street to a point 221.16 feet Northwesterly beyond the inter section of the centerline of Dogwood Street and 4th Avenue, and to improve 4th Avenue from Dogwood Street to Cedar Street by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs,side walks and asphalt concrete pavement;to improve Buell Drive from Market Street to Murphy Street,Gary Street from a point 170 feet West of the centerline of Grape Drive to the West boundary i>f Larson Plat,Charlotte Street from a point 119 feet West of the centerline of Grape Drive to Buell Drive, Kristine Street from Grape Drive to Charlotte Street,Bruce Street from Grape Drive to Buell Drive,Murphy Street from Grape Drive to 625 feet West by grading,graveling,construc ting and installing storm drainage,side lateral sewer connec tions,curbs,sidewalks and asphalt concrete pavement;to improve Market Street,Gary Street,Daniel Street,Mary Street, Timothy Lane and Steven Lane,all within the boundaries of Larson Plat No.2 and the Replat of Block 2,Larson Plat No.2, by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement;to improve Ivy Street from "C"Street to Lakeside Drive by grading,graveling,construc ting and installing storm drainage,side lateral sewer connec tions,curbs,sidewalks and asphalt concrete pavement;to improve Orchard Avenue from West Broadway (SSH 7-3)to Peninsula Drive,Texas Street from Orchard Avenue to Russell Avenue,Russell Avenue from Texas Street to 135 feet west of the centerline of Wall Street,Wall Street from Russell Avenue to Yakima Avenue,Wall Street (SEi)from Yakima Avenue west to the end of Russell Addition,and Yakima Avenue (E2)in Russell Addition by grading,graveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement;to improve Spruce Street from Orchard Avenue to Barbara Street by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs, sidewalks and asphalt concrete pavement;to improve Crest Drive from Vista Drive to Evelyn Drive by grading, graveling,constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement;and to create a local improvement district to assess the cost and expense of each contin uous unit of said improvements against the properties in such district specially benefited thereby;and notifying all persons who may desire to object to said improvements to appear and present their objections at a meeting of the City Council to be held on March 27,1962. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON,as follows: Section 1:That it is the intention of the City Council of the City of Moses Lake,Washington,to order the following improvements within the City of Moses Lake,Washington: (1)The construction and installation of approximately 290 feet of 6"water main with necessary hydrants,valves and fittings on Balsam Street south from 9th Avenue to serve Lots 27, 28,29,30, 39,40,41 and 42 of Garden Heights Addition No.2,and the construction and installa tion of approximately 580 feet of 6"water main with necessary hydrants,valves and fittings on Garden Drive south from 9th Avenue to serve Lots 1,2,3,4,5,6, 7,20,21, 22,23,24,25 and 26 of Garden Heights Addition No.2,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.1-A". (2) The construction and installation of approximately 230 feet of 8"sewer main and necessary manholes on Balsam Street south from 9th Avenue to serve Lots 27,28, 29,30, 39, 40,41 and 42 of Garden Heights Addition No.2,and the construction and installation of approximately 430 feet of 8"sewer main with necessary manholes and lampholes on Garden Drive south from 9th Avenue to serve Lots 1,2, 3/4,5,6,7,20, 21,22,23,24,25,and 26 of Garden Heights Addition No.2,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.1-B". (3)The improvement of Balsam Street from Skyline Drive to 9th Avenue,and Garden Drive from Hill Avenue to 9th Avenue by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs, sidewalks and asphalt concrete pavement,all of the fore going being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.1". - 2 - u (4)The improvement of the West half of Clover Drive and the East half of Grand Drive from North Terrace Addition to Hawthorne Drive,and the North half of Hawthorne Drive from Grand Drive to Clover Drive by grading, graveling,constructing and installing storm drainage, side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.2 ." (5)The improvement of Walnut Street from Chestnut Street to Pioneer Way by grading,graveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.3." (6) The construction and installation of approximately 1250 feet of 8"sewer main with all necessary manholes beginning at the sewer lift station on Wheeler Road at Fig Street;thence Southwesterly through a portion of Assessor's Tax No.447-A and adjacent to Tax No.598 to Pioneer Way;thence Westerly across Pioneer Way to Walnut Street;thence Southwesterly along Walnut Street to the alley between Block 10 of Rittenhouse Addition and Besselman Addition;thence Southeasterly along said alley to a point which is 225 feet from the centerline of Walnut Street,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.3-A". (7)The improvement of Dogwood Street from "A"Street to a point 221.16 feet Northwesterly beyond the intersection of the centerline of Dogwood Street and 4th Avenue,and the improvement of 4th Avenue from Dogwood Street to Cedar Street by grading,graveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.4." (8)The improvement of Buell Drive from Market Street to Murphy Street,Gary Street from a point 170 feet West of the centerline of Grape Drive to the West boundary of Larson Plat,CharlotteeStreet from a point 119 feet West of the centerline of Grape Drive to Buell Drive,Kristine Street from Grape Drive to Charlotte Street,Bruce Street from Grape Drive to Buell Drive,Murphy Street from Grape Drive to 625 feet West by grading,graveling, constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.5." (9) The improvement of Market Street,Gary Street,Daniel Street,Mary Street,Timothy Lane and Steven Lane,all within the boundaries of Larson Plat No.2 and the Replat of Block 2,Larson Plat No.2,by grading,graveling, constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.6." - 3 - u (10)The improvement of Ivy Street from "C"Street to Lakeside Drive by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs, sidewalks and asphalt concrete pavement,all of the fore going being one continuous unit of the proposed improve ment and hereafter referred to as "Unit No.7." (11)The improvement of Orchard Avenue from West Broadway (SSH 7-E)to Peninsula Drive;Texas Street from Orchard Avenue to Russell Avenue;Russell Avenue from Texas Street to 135 feet west of the centerline of Wall Street; Wall Street from Russell Avenue to Yakima Avenue;Wall Street (SE i)from Yakima Avenue west to the end of Russell Addition; and Yakima Avenue (E i)in Russell Addition by grading,graveling,constructing and installing storm drain age,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.8." (12)The improvement of Spruce Street from Orchard Avenue to Barbara Street by grading,graveling,constructing and installing storm drainage,side lateral sewer connections, curbs,sidewalks and asphalt concrete pavement,all of the foregoing being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.9." (13)The improvement of Crest Drive from Vista Drive to Evelyn Drive by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs, sidewalks and asphalt concrete pavement,all of the fore going being one continuous unit of the proposed improvement and hereafter referred to as "Unit No.10." All of the foregoing shall be in accordance with the plans and specifica tions therefor prepared by J.Garth Anderson,Public Works Director and City Engineer. Section 2:That the entire cost and expense of said improvement shall be borne by and assessed against the property specially benefited by such improvement to be included in the local improvement district to be established,embracing,as near as may be,all property specially benefited by such improvement;PROVIDED,HOWEVER,that in the event the actual total cost and expense of said improvement shall exceed the preliminary cost estimate of the public works director and city engineer by more than ten percent (10%),the City shall pay that portion of said cost and expense which exceeds said ten percent (10%).That - 4 - the assessment rates shall be computed on the basis of the cost and expense of each continuous unit of said improvement,as above described. Section 3:That all persons who may desire to object to the improvement herein mentioned are hereby notified to appear and present such objec tions at a meeting of the City Council to be held in the Council Chambers in the City Hall,Moses Lake,Washington,at 8:00 o'clock p.m.,on March 27,1962,which time and place are hereby fixed for hearing all matters relating to said proposed improvement,and all objections thereto, and for determining the method of payment for said improvement. Section 4:J.Garth Anderson,Public Works Director and City Engineer, is hereby directed to submit to the City Council on or prior to the 27th day of March,1962,all data and information required by law to be submitted.
