354u RESOLUTION No.354 A RESOLUTION DECLARING INTENTION TO TEMPORARILY CONTINUE WATER AND SEWERAGE FACILITIES LEASE WITH THE UNITED STATES: AUTHORIZING APPLICATION FOR PERMIT TO CONSTRUCT IMPROVEMENTS TO SEWERAGE FACILITIES AND ON RIGHTS OF WAY OF THE UNITED STATES:REQUESTING THE BUREAU OF RECLAMATION TO APPLY TO GENERAL SERVICES ADMINISTRATION FOR TRANSFER OF WATER AND SEWERAGE FACILITIES AND RIGHTS OF WAY TO THE CITY OF MOSES LAKE:AND DECLARING THE INTENT OF THE CITY OF MOSES LAKE TO THEREAFTER MAINTAIN SAID FACILITIES AND PROVIDE WATER AND SEWER SERVICE AT SPECIFIED RATES TO THE BUREAU OF RECLAMATION FACILITIES AS A CONDITION OF TRANSFER WHEREAS,under date of August 26,1952 a lease was entered into between the CITY OF MOSES LAKE and THE UNITED STATES OF AMERICA for certain water and sewerage facilities of the United States located in Sections 14 and 23,Township 19 North,Range 28 East,Willamette Meridian;and WHEREAS,although there has been no formal extension of this lease which would be effective at the present time,the City and the United States have operated under the terms and spirit of said lease;and WHEREAS,it is the desire of the City of Moses Lake that it continue to operate and use said water and sewerage facilities under the terms and spirit of the above-said 1952 lease;and WHEREAS,the City is desirous of doing certain construction and improve ment work on the rights of way and to the above-said sewerage facilities of the United States and wishes a permit from the United States to do this work until such time as Federal permission can be secured authorizing transfer of the Bureau of Reclamation's rights of way and water and sewerage facilities involved to the City;and i—WHEREAS,the City of Moses Lake is desirous of requesting the Bureau of Reclamation to apply to the General Services Administration for a transfer of the said water and sewerage facilities to the City of Moses Lake;and u Resolution No.354 (Continued) WHEREAS,the City of Moses Lake has,since August 26,1952,maintained and improved the facilities above mentioned,and in the event of transfer of said facilities,the City intends to maintain and improve same;and WHEREAS,in the event of transfer of the facilities,the City of Moses Lake intends to continue to provide water and sewerage services to the Bureau of Reclamation facilities; NOW,THEREFORE,BE IT RESOLVED,that the City Manager of the City of Moses Lake is hereby authorized on behalf of the City of Moses Lake to express to the Bureau of Reclamation a desire to continue operation for the time being of the above-said water and sewerage facilities under the terms and spirit of the above-said lease of August 26,1952; BE IT FURTHER RESOLVED that the City Manager is authorized and directed to request permission of the United States to perform construction and improvement work to the sewerage facilities of the United States and on its rights of way; BE IT FURTHER RESOLVED that the City of Moses Lake requests the Bureau of Reclamation to forthwith make application to the General Services Ad ministration of the United States for transfer of the water and sewerage facilities and rights of way above referred to,to the City of Moses Lake. BE IT FURTHER RESOLVED that upon transfer of the water and sewerage facilities to the City of Moses Lake,the City of Moses Lake will thereafter maintain said systems in their entirety up to the point where the sewer mains connect with the side sewer laterals insofar as the sewerage facilities are concerned,and up to and including the water meters inso far as the water system facilities are concerned. BE IT FURTHER RESOLVED that in the event of transfer,the City of Moses Lake will provide,without cost,ten sewer services consisting of eight permanent residences,one office building and one shop building,property Resolution No.354 (Continued) of the United States Bureau of Reclamation,so long as said facilities are used and operated by the Bureau of Reclamation. BE IT FURTHER RESOLVED that in the event of transfer,the City of Moses Lake will continue water service to the Bureau of Reclamation facilities above enumerated,or any additions thereto,at water rates in accordance with existing wate r rate schedules of the City of Moses Lake now in effect or as hereafter amended.
