WHEREAS,Resolution No.238 provides that all grants of real estate or
any interest therein to the City of Moses Lake shall not be accepted until a
Resolution of Acceptance has been duly passed by the City Council,and
WHEREAS,JOE J.ERNST and CLARA ERNST,Husband and wife,have presented
a statutory warranty deed conveying property to the City of Moses Lake,NOW
THEREFORE
BE IT RESOLVED:That the statutory warranty deed for the following described
property is hereby accepted by the City of Moses Lake:
That portion of the North half (Ni) of the Southeast Quarter (SE?)
of Section 27,Township 19 North,Range 28 EWM.,lying Westerly
of the Chicago,Milwaukee and Pacific Railway Company right of way;
EXCEPT that portion thereof described as follows:
Beginning at the monument located at the intersection of the North
line of the Southeast Quarter (SEs)of said Section 27 and the center
of Beaumont Drive as shown on the map of Montlake Addition No.1,
Moses Lake,Washington,as per plat recorded in Volume 5 of Plats,
Page 45,records of Grant County,Washington;thence North 89057'51"
West along the said North line a distance of 543 .40 feet to the true
point of beginning;thence South 0o02'09"West 140 feet;thence
North 89°57'51"West to the West line of the Southeast Quarter (SEs)
of said Section 2 7;thence North along said West line 140 feet,more
or less,to the center of said Section 2 7;thence South 89°57'51"East
to the true point of beginning.
EXCEPT (1)an easement granted to the Washington Water Power
Company for the purpose of maintaining an electrical distribution
line over the South half (Si)of the property herein described,as
disclosed by instrument filed May 31,1945 as File No.110611
over the South half (Si) of the North half (Ni)of the Southeast
Quarter (SGI)of Section 27, Township 19 North,Range 28 EWM.,
Grant County,Washington.(2) An easement granted to the
Washington Water Power Company for the purpose of maintain
ing an electrical distribution line over the North half (Ni)of the
property herein described,as disclosed by instrument filed May 31,
1945 as File No.110612,over the North half (Ni)of the North
half (Ni) of the Southeast Quarter (SE?)of Section 27,Township
19 North,Range 28 EWM.,Grant County,Washington;(3)The
City hereby covenants that it shall grant ingress and egress over
the park property referred to above to the owners of the following
described piece of property,or their successors or assigns at
all times:
That portion of the North half (Ni) of the Southeast Quarter (SE?)
of Section 27,Township 19 North,Range 28 EWM. ,lying Westerly
of the Chicago,Milwaukee and Pacific Railway Company right of
way described as follows:Beginning at the monument located at
the intersection of the North line of the Southeast Quarter (SEl)
of said Section 27 and the center of Beaumont Drive as shown on
the map of Montlake Addition No.1,Moses Lake,Washington,
as per plat recorded in Volume 5 of Plats,page 45,records of
