A-8NO A 8 AMENDED RESOLUTION RESOLUTION OF INTENTION TO ORDER THE CONSTRUCTION OF SIDEWALKS AND CURBS ALONG AND UPON CERTAIN STREETS IN THE TOWN OF MOSES LAKE,FORMERLY NEPPEL,AND TO ESTABLISH A LOCAL IMPROVEMENT DISTRICT TO EE KNO'.VN AS "LOCAL IMPROVEMENT DISTRICT NO. 1"TO PAY FOR ALL THE COST OF CONSTRUCTION OF SAID SIDE77ALKS AND CURBS. Whereas,the Town Council of the Town of Moses Lake has been petitioned by a number of property owners to construct sidewalks and curbs along and upon certain streets in the Town of Moses Lake hereinafter more fully described. Now,therefore,be it resolved that it is the intention of the Town Council of the Town of Moses Lake to establish a Local Improvement District to pay for the construction of sidewalks and curbs, and that the property within such Improvement District shall pay the entire cost and expense of the improvement to be made and hereinafter more completely descrived, which cost and expense shall be levied and collected as an assessment upon the real property in the said Local Improvement District so created,and shall be paid in ten (10) annual installments,the first of which shall be paid within thirty (30)days after the approval and acceptance of the proposed improvement by the Town Council,and after demand having been made therefor by the Town Treasurer. The remaining payments shall bear interest at the rate of six (6)per cent per annum,and shall be collected annually as an Ordinance providing for the establishment of such Local Improvement District shall provide. The nature and territorial extent of the improvement herein contemplated is descrived as follows: 1. The construction of a concrete curb along both sides of Broadway Street,commencing at the '.Vest side of Birch Street and ending at the East side of Beech Street in Neppel, now Moses Lake. 2.The construction of a concrete sidewalk ten (10)feet wide along the Southeasterly side of Broadway Street,commencing at the most Northwesterly corner of Lot 15,in Block 16,of Neppel,now Town of Moses Lake,and ending on the East side of Beech Street. 3. The construction of a concrete sidewalk ten (10)feet wide along the Northwesterly side of Eroadway Street, commencing at the Vfest side of Birch Street and ending at the most Southeasterly corner of Lot 4, in Block H of Neppel, now Town of Moses Lake. 4. The construction of a concrete sidewalk five (5)feet wide,and a concrete curb on both sides of Ash Street, commencing at Broadway Street and running thence Southeasterly a distance of 1/2 block to the alley. 5. The construction of a concrete sidewalk five (5)feet wide, and a concrete curb on both sides of Germania Street,commencing at Broadway Street and running thence Southeasterly a distance of 1/2 block to the alley. 6.The construction of a concrete sidewalk five (5)feet wide,and a concrete curb on both sides of Alder Street,commencing at Broadway Street and running thence Southeasterly a distance of 1/2 block to the alley. That it is contemplated, and it is the intention of the Town Council of the Town of Moses Lake to organize into a Local Improvement District,to be known as Local Improvement District No.1,the following described lots and tracts of land, to-wit: Lots 1 to 12,inclusive,in Block 31,of Neppel,Now Town of Moses Lake; Lots 1 to 12,inclusive,in Block 26,of Neppel,now Town of Moses Lake; Lots 1 to 12,inclusive,in Block 21,of N'eppel,now Town of Moses Lake; Lots 1 to 6,inclusive,and Lots 13 to 17,inclusive,in Block 16,of Neppel,now Town of Moses Lake; Lots 1 to 12 inclusive,in Block E,of Neppel,now Town of Moses Lake; Lots 1 to 12,inclusive,in Block F,of Neppel,now Town of Moses Lake; Lots 1 to 12,inclusive,in Block G-,of Neppel,now Town of Moses Lake; Lots 1 to 12,inclusive,in Block H,of Neppel,now Town of Moses Lake; and a tract of land described as: A portion of vacated Germania Street,a street in Neppel,Grant County '.Washington,according to the plat thereof filed October 15,1912,immediately adjacent to Lot 1,Block G in said plat and described by metes and bounds as follows;Commencing at the intersection of the Northeasterly boundary line and the Southeasterly boundary line of said Lot 1;running thence Northwesterly on the Northeasterly boundary line of said Lot 1 a distance of 70 feet;running thence North 53°40*54"East a distance of 35 feet, running thence South 36°19'06M East,parallel with the Northeasterly boundary line of said Lot 1, a distance of 70 feet to an intersection with the Northwesterly boundary line of Broadv/ay,a street in said plat, running thence South 53°401 54"West along the Northwesterly boundary line of said Broadway,a distance of 35 feet, to the point of begining. Be it further resolved,that the 16th day of May, 1944, at the hour of 8:00 o'clock P.M.in the Council Chambers of the Town Council in the Town Hall in Moses Lake, Washington,he and the same is hereby fixed as the time and place for the hearing of this Amended Resolution, at which time any person having any objection to the establishment of said proposed Local Improvement District may appear and have his objection heard. Be it further resolved,that the Town Clerk of the Town of Moses Lake at or prior to the 16th day of May, 1944, the time fixed for the hearing of this Amended Resolution,shall submit to the Town Council an estimate of the cost and expense of the improvement herein contemplated,and a statement of the proportionate amount thereof which shall be borne by the property within the proposed Local Improvement District according to the valuation placed upon it for the purpose of general taxation, and based also upon the benefits received therefrom,together with a diagram or plat shewing thereon the lots, tracts and parcels of land, and other property which will be specifically benefited thereby, and the estimated amount of the cost and expense of such improvement to be borne by each lot, tract or parcel of land, or other property, and Be it further resolved, that notice of the hearing of this Amended Resol ution shall be give by the Clerk to each owner or reputed owner of any lot, tract or parcel of land, or other property specifically benefited by the proposed improvement,by mailing to the owner or the reputed owner of the property as shaown in the tax rolls of the County Treasurer of Grant County, end addressed as shown in the tax'rolls of the Treasurer of Grant County .Washington,and to the address shown thereon,a notice setting forth the na ture of the proposed improvement,the total estimated cost, and the estimated benefits to the particular lot, tract or parcel of land, and the date of the hearing before the Town Council as provided in this Amended Resolution. Such notice shall be nailed as hereinbefore provided,at least fifteen (15) days prior to the date fixed for such hearing, and Be it further resolved,that this Amended Resolution shall be published in two consecutive issues of the Columbia Basin Herald in Moses Lake,Washington, the first publication to be at least fifteen (15)days prior to the date herein fixed for said hearing.
