RESOLUTION

Whereas, The United States of America, acting by and through the Federal
Vforks Administrator,is contemplating the installation of a sewer system in the
State of 7/ashington,under its Project known as V/ashington 45-250-F;and
WHEREAS,it is necessary that certain pipelines,accessories and
appurtenances for the conveyance and distribution of sewage be placed under the
public streets or through public property of the Town of Uoses Lake,County of Grant
State of V/ashington,for the development and construction of said sewer system;
NOW,THEREFORE,in consideration of the sum of One Dollar ($1.00)and
other good and valuable consideration,receipt of which is hereby acknowledged,
the Town of Ivloses Lake does hereby grant to the United States of America and its
assigns a right-of-way to go upon and across said public streets or other public
property and to install,maintain and operate thereunder such line of pipe,i
accessories and appurtenances as shall be necessary to the proper development of
said system.
The Grantor does not assume any liability for injury,or damage to any
person or property incident to, or that may arise during and in consequence of.
(a)the use, occupancy and enjoyment in accordance with this agreement
by the Grantee of the lands, premises and right-of-way of said Grantor; or
(b)the construction of,presence of,maintenance of,or failure to properly
and safely construct, operate,maintain and use said structures, and the
Grantee agrees to use,occupy and enjoy the lands,premises and right-of-
way of said Grantor,and to use,employ and maintain said structures and
appurtenances with all reasonable diligence and precaution to avoid
damage to or obstruction to the streets or public property of the Grantor.
Provided,however,that said streets and property so affected shall not
be unnecessarily disturbed and shall be restored to as good condition
as they were in when the laying of the pipeline here permitted was begun:
that traffic thereon shall not be unnecessarily obstructed.
