MOSES LAKE CITY COUNCIL MEETING MINUTES UNIFIED DEVELOPMENT CODE WORKSHOPS 2024
The City has engaged the public throughout the drafting process by holding several planning
commission meetings and public hearings; establishing a development committee composed of
city council members, city staff, and members of the local development community; posting the
revised codes on the website; and holding a variety of meetings with stakeholder groups
including the Downtown Association, Parks Board, and Chamber.
Beginning in June of 2024 the City Council and Planning Commission held multiple joint study
sessions to review certain portions of the drafts as follows:

· Part 6: Chapter 15.730 – Non-Conforming Uses· Part 7: Chapter 15.250 – Concurrency· Part 8: Chapter 15.525 –Wetland Critical Area Buffers
A SEPA Determination of Non-Significance (DNS) was issued on May 10, 2024. The 14-day
comment period ended May 30, 2024.
The City submitted the draft to the Department of Commerce on April 11, 2024, and has provided the revisions to that draft to date.
Public comments received from the public hearings before the planning commission and as part of the SEPA process have been reviewed and incorporated into the draft where appropriate. On September 9, 2024, the Planning Commission held its final public hearing and adopted Resolution No. 2024-1 recommending adoption of the Unified Development Code by the City
Council.
The draft ordinance replaces the following titles of the Moses Lake Municipal Code with a Unified Development Code:
· Title 14, Environmental Regulations
· Title 17, Subdivisions· Title 18, Zoning· Title 19, Growth Management·Title 20, Development Review Process
·Title 21, Development Impacts
The Unified Development Code (UDC) contains all of the zoning and development regulations for the City of Moses Lake, except for the building code which is being retained in Title 16. The UDC is split into parts as follows:

A second ordinance was drafted to move the code provisions establishing the office of the hearing examiner from the zoning code into Title 2, Administration and Personnel. While the hearing examiner is a vital part of the administration of the development regulations, the hearing examiner also serves as the appellate body for other code procedures including general code enforcement and therefore establishing the office under this title is more appropriate for the
entire municipal code. A third ordinance was drafted to moves the previous water rights transfer or fee in lieu requirement from the subdivision code into Title 13, Water, Sewers, and Public Utilities. Ordinance No. 3053 also changes the trigger for requiring transfer of water rights or a fee in lieu
from the point of subdivision to the point of annexation or filing a building permit. For building permits filed on a parcel that has already transferred or paid the fee in lieu either during annexation or during subdivision under the previous code, the property owner will be deemed to have already met this requirement if the use of the property is the same.

The regular meeting of the Moses Lake City Council was called to order at 6:30 p.m. by Mayor Swartz in the Council Chambers of the Civic Center with audio remote access. Special notice for remote attendance and citizen comment were posted on the meeting agenda.

Mayor Swartz read and presented a proclamation to Fire Chief Brett Bastian.

CITIZEN’S COMMUNICATION
Residential Vandalism – Ida Deeds, Moses Lake, shared with Council that she has reported her
neighbor to the police again since he resumed construction of a backyard weapon.
PUBLIC HEARING
#1 Unified Development Code Ordinance 3051 and Hearing Examiner and Water Rights Ordinances 3052/3053
City Attorney Anna Franz provided a slide deck to summarize main changes being presented. A
consultant was hired to prepare a draft update to zoning regulations and held several public forums in 2023. The Council and Planning Commissioners held multiple joint study sessions to review draft prepared by the consultant over the course of the last few months. The Planning Commission conducted a new public hearing on September 13 and recommends adoption.
Mayor Swartz opened the Council’s public hearing at 6:50 p.m. One resident provided
testimony on her concerns of vacation rental and home occupation regulations. There being no further comment, the hearing was closed at 7:10 p.m.
Action taken: Council Member Fancher moved to adopt Ordinance 3051 as presented, second by Council Member Lombardi. The motion carried 7 – 0.

Maple Ridge Planned Development District Ordinance 3056
The staff report was distributed to Council at the meeting. Interim Community Development Director
Vivian Ramsey provided an overview of the project. Mayor Swartz recited the opening statement for a quasi-judicial proceeding to consider the Hearing Examiner’s recommendation that was received yesterday. Testimony was opened at 7:27 p.m. and with no one present for comments, Mayor Swartz closed the hearing. Council discussed lot size setbacks, WSDOT traffic study, and parking impacts.
Staff will bring answers to Council’s questions at the next regular meeting.

Staff presented an ordinance to remove nine items in the Code that have exceeded the 15-year statute of limitations.
Action taken: Council Member Fancher moved to adopt Ordinance 3054 with corrected
reference to statute RCW 35.72.020, second by Council Member Lombardi. The motion carried 7 – 0. ADMINISTRATIVE REPORTS
Excess Water Usage Update
Finance Director Madeline Prentice met with the staff Water Resource Committee (WRC) where they reviewed data showing a reduction in water usage since restrictions for watering days was implemented. The city parks still hold the highest usage, and parks staff continue to work on immediate shutoff when leaks are detected and converting spaces to xeriscape. The WRC will present usage data and ideas on spending
the excess use charges to Council on November 19. Over one-quarter of the 10,000 new smart meters have been installed.
COUNCIL COMMUNICATIONS AND REPORTS
Council Member Myers reported that Grant Transit Authority has put their first of four electric buses in service. The Council Community Development and Public Works Committee also
discussed the need for a lobbyist to help secure grant funds. Council Member Martinez attended the MLIRD State of the Lake presentation, she will attend the Board of Health conference in Leavenworth next week, and invited everyone to the Battle of the Badges softball game.
Council Member Fancher shared that there was discussion at the Economic Development Committee meeting about private sector battery plants receiving hundreds of millions in federal grants and thought their lobbyist might be a resource to help with the city’s infrastructure to support this growth.
Council Member Lombardi has tracked one billion dollars in federal grants injected into the community overall. Deputy Mayor Madewell attended the Solid Waste Advisory Committee where they voted to
expand the landfill instead of moving to a regional transfer station program. They are discussing the possibility of curbside organic material pickup. Mayor Swartz reported on the Parks, Recreation, and Cultural Services (PRCS) Committee futsal
court construction that is complete except for painting that will occur in the spring. The ice rink
chiller repair completion is pending quotes to fix newly discovered leaks. PRSC Director Doug Coutts also provided an update to Valley Road landscaping to be completed mid-October. ADJOURNMENT

RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW
42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at
least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the
above format for approval by the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering
services or performing labor must be certified by the appropriate official to ensure that the materials have
been furnished, the services rendered, or the labor performed as described, and that the claims are just, due
and unpaid obligations against the City.
RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been
met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body
has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the
legislative body had adopted policies that implement effective internal control; (3) the legislative body has
provided for review of the documentation supporting the claims within a month of issuance; and (4) that if
claims are disapproved, they shall be recognized as receivables and diligently pursued.
The City meets all these conditions.
To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council
approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments
during the period prior to the date of the Council meeting.
All payments made during this period were found to be valid claims against the City. Details are attached and
any questions should be directed to the City Manager or Finance Director.
The City's internal controls include certification of the validity of all payments by the appropriate department prior
to submission for payment. The Finance Director has delegated authority for the examination of vouchers and
authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and
validated. The Finance Division regularly reviews it processes to ensure appropriate internal controls are in
place.

RESOLUTION NO. 3988
A RESOLUTION INITIATING THE PROCEDURE FOR
VACATING RIGHT-OF-WAY DEDICATED FOR THE
DEVELOPMENT OF AN ALLEY IN THE LEWIS ELLIOTT
ADDITION NO.2 ADJACENT TO LOTS FIVE AND
TWELVE AND GRANT COUNTY ASSESSOR’S PARCEL
NUMBERS 1011315000 AND 101309000.
Recitals:
1. There exists right-of-way dedicated for the development of an alley in the
Lewis Elliott Addition No.2 adjacent to lots five and twelve and County
Assessor’s Parcel Numbers 1011315000 and 101309000.
2. RCW 35.79 provides that a public street or alley may be vacated upon
resolution initiated and passed by the legislative authority of the
jurisdiction where the street or alley is situated and that such resolution
shall fix a time when the petition will be heard and determined, and which
shall not be more than sixty dates nor less than twenty days after the
passage of such resolution.
Resolved:
1. The vacation of the following described public right-of-way shall be
initiated:
That portion of the city alley right of way between West Broadway
(Marina Dr.) and Third Avenue, described on the plat of Lewis Elliot
Addition No.2 recorded March 17, 1954, recorded under Grant County
Auditor's File Number 218583; All of said city street right of way is
located in the Section 22, Township 19 North, Range 28 East, W.M., City
of Moses Lake, County of Grant, State of Washington as shown on the
attached Exhibit 'B' and is more generally described as follows:

City staff has put together a draft agreement with the Moses Lake Irrigation and Rehabilitation District for the
ownership and ongoing maintenance and operation of the Iconic Moses Lake Fountain with the following
stipulations:
Contingent upon approval of LTAC funds for the $36,480 in estimated repairs
The City take on ownership of the fountain and become responsible for ongoing maintenance once repairs
are completed
MLIRD and the City jointly install the fountain in the spring and remove the fountain in the fall
MLIRD continue to be responsible for all utilities associated with the fountain’s ongoing operation
Indemnification language/insurance language/ joint 30-day termination clause etc.
Staff has an application in the process for LTAC funds in the current cycle. LTAC application approval
recommendations should be coming to City Council at the October 22nd Council Meeting. The funding impact
listed in the application is for LTAC funds.
The City would be committing to budgeting amounts for the ongoing maintenance and repair of the fountain in
the future. PRCS staff would include amounts for annual maintenance each year in its budget.

INTERLOCAL AGREEMENT BETWEEN CITY OF MOSES LAKE AND MOSES LAKE
IRRIGATION AND REHABILITATION DISTRICT FOR THE OWNERSHIP, REPAIR, AND
OPERATION OF THE MOSES LAKE FOUNTAIN
This Agreement is made by and between the City of Moses Lake, Washington, a noncharter code
city (“City”), and Moses Lake Irrigation and Rehabilitation District, a special purpose district
(“MLIRD”), for the ownership, repair, and operation of the Moses Lake Fountain.
Recitals:
1. MLIRD owns the Moses Lake Fountain (“Fountain”) which it acquired from the Port of Moses
Lake.
2. The Fountain needs substantial repairs before it can be placed back in Moses Lake for operation.
3. Neither MLIRD nor the City have budgeted funds sufficient to cause the needed repairs to the
Fountain.
4. The City can apply for LTAC funds to make the needed repairs if the Fountain is owned by the
City.
5. MLIRD wishes to transfer ownership of the Fountain to the City and the City is willing to accept
ownership of the Fountain subject to the terms and conditions of this Agreement.
6. RCW 39.34, the Interlocal Cooperation Act, provides the capability for public agencies to
cooperate for mutual advantage in providing services.
Agreement:
1. Term. This Agreement shall be effective when signed by the duly authorized governing bodies of
the City and the MLIRD and shall remain in full force and effect until the purposes set forth
herein are achieved, or until terminated by either Party upon 30 days’ prior written notice,
whichever occurs first.
2. Transfer of Ownership of Fountain. The MLIRD shall transfer by bill of sale (attached hereto)
ownership of the Fountain to the City upon execution of this Agreement.
3. Repairs. Upon transfer of ownership of the Fountain to the City, City shall apply for $35,000.00
in LTAC funds for the needed repairs of the Fountain. The City’s responsibility to make the
needed repairs of the Fountain is contingent on the successful application and award of the LTAC
funds.
4. Installation, Operation, and Maintenance of Fountain. Once the Fountain is repaired and fully
functional, the Parties shall jointly install the Fountain during the Spring and shall jointly remove
the Fountain in the Fall. Expenses and labor for installation and removal shall be shared equally
by the Parties. MLIRD shall be responsible for payment of all utilities associated with the
Fountain’s annual operations. The City shall be responsible for the routine maintenance of the
Fountain provided sufficient funds are available for such maintenance requirements.
5. Hold Harmless and Indemnification. Each Party shall hold harmless and indemnify the
other Party and its directors, officers, employees, agents and representatives against any
and all loss, liability, damage, or expense, including any direct, indirect or consequential
loss, liability, damage, or expense, but not including attorney's fees unless awarded by a
court of competent jurisdiction, for injury or death to persons, including employees of
either Party, and damage to property, including property of either Party, arising out of or

in connection with intentional, willful, wanton, reckless or negligent conduct. However,
neither Party shall be indemnified hereunder for any loss, liability, damage or expense
resulting from its sole negligence or willful misconduct. Both parties shall maintain liability and
property insurance appropriate for their entity.
6. Contract Management. Administration of Agreement. There shall be no separate legal entity
created by the Agreement. This Agreement shall be administered jointly by the MLIRD or
designee and the City or designee.
7. Maintenance of Records. Each party hereto agrees to maintain books, records and documents
using accounting procedures which accurately reflect all direct and indirect costs related to the
performance of services described herein. Each party may examine the other party's books and
records to verify the accuracy of invoices. Each party's fiscal management system shall include
the capability to provide accurate and complete disclosure of all costs invoiced under this
Agreement. All books, records, documents and other materials relevant to this agreement will be
retained for six years after expiration of the Agreement, and the Office of the State Auditor or
other persons authorized by law and any persons duly authorized by the parties shall have full
access and the right to examine any of these materials during this period. Each party will utilize
reasonable security procedures and protections to assure that records and documents provided by
the other party are not erroneously disclosed to third parties.
8. Assignment. This Agreement cannot be assigned, transferred or any portion subcontracted by
either party hereto without the prior written consent of the other party, which consent shall not be
unreasonably withheld.
9. Property. The terms of this Agreement do not contemplate the acquisition of any real or personal
property beyond the transfer of the Fountain ownership from MLIRD to City. Unless otherwise
specifically agreed by the parties in writing, all property, personal and real, utilized by the parties
hereto in the execution of this Agreement shall remain the property of that party initially owning
it.
10. Compliance with Laws. Each party hereto, in its performance of this Agreement, agrees to
comply with all applicable local, State, and Federal laws and ordinances. Relationship of the
Parties. No agent, employee or representative of City shall be deemed to be an agent, employee or
representative of the MLIRD for any purpose, and the employees of City are not entitled to any of
the benefits the MLIRD provides to MLIRD employees. No agent, employee or representative of
the MLIRD shall be deemed to be an agent, employee or representative of City for any purpose,
and the employees of the MLIRD are not entitled to any of the benefits City provides to City
employees.
11. Disputes. If a dispute arises under this Agreement, it shall be determined by a majority vote of a
three-member Dispute Resolution Board comprised of one representative chosen by each of the
parties hereto and a third chosen by the two selected parties. If said determination is not
acceptable to the parties, the parties are entitled to utilize whatever remedies to which they may
be entitled at law or in equity.
12. Jurisdiction. Any legal dispute between the parties to this Agreement shall be governed by the
laws of the State of Washington, and any action to enforce this Agreement shall be brought in
Grant County, Washington.

13. Modification. The provisions of this Agreement may be modified or amended only by written
mutual written agreement of the parties, executed by personnel authorized to bind each of the
parties.
14. Waiver. A failure by either party to exercise its rights under this Agreement shall not preclude
that party from subsequent exercise of such rights and shall not constitute a waiver of any other
rights under this Agreement unless stated to be such in a writing signed by an authorized
representative of the party and attached to the original Agreement.
15. Agreement Not or Benefit of Third Parties. This Agreement is entered into solely for the benefit
of the parties hereto and vests no rights in, or is it enforceable by, any third parties.
16. Severability. If any provision of this Agreement or any provision of any document incorporated
by reference shall be held invalid, such invalidity shall not affect the other provisions of this
Agreement which can be given effect without the invalid provision, if such remainder conforms
to the requirements of applicable law and the fundamental purpose of this agreement, and to this
end the provisions of this Agreement are declared to be severable.
17. Filing. This Agreement shall be filed or posted online as required by RCW 39.34.040.
18. Effective Date: This agreement shall take effect when signed by the parties.

Council has received historically consistent complaints from ci zens and the Grant County Animal Shelter about
the parking lot and public right of way sales of puppies and ki ens in the City. Ci zens have asked the City
Council to consider adop ng legisla on that would prohibit such sales in an effort to reduce the number of
unaltered, stray, and abandoned animals in the City.
Council member Lombardi has requested a draft ordinance for presentation to the City Council which is attached
hereto. This ordinance would prohibit the display, sale, delivery, offer for sale, barter, auction, giving away, or
advertising of animals on public property and private property open to the public (e.g., parking lots). The prohibition
would not apply to sales on private property not open to the public, at pet shops or kennels, or at animal shelters.
Violation of this ordinance would carry a C-1 penalty ($1,000.00) as a deterrent for such conduct.
There are no fiscal implica ons for the City beyond rou ne enforcement.

ORDINANCE NO. 3055
AN ORDINANCE OF THE CITY OF MOSES LAKE, WASHINGTON, PROHIBITING THE SALE OF ANIMALS IN PLACES OPEN TO THE PUBLIC THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. Creation. Moses Lake Municipal Code Section 6.14.100 titled “Prohibited Sales” of Chapter 6.14 titled “Miscellaneous Provisions” is hereby created to read as follows:
6.14.100 Prohibited Sales.
A. No person shall display, sell, deliver, offer for sale, barter, auction, give away, dispose, or advertise the availability of an animal upon any public property or upon private property open to the public. B. No person shall allow the display, sale, delivery, offering for sale, barter, auction, giving
away, disposal, or advertisement of the availability of an animal upon private property
open to the public under their control. C. For purposes of this section, public property shall include, but not be limited to, any city-owned real property, air space, or other interest in real estate, including streets, roads, alleys, or other public rights-of-way, owned by or controlled by the city of Moses
Lake. For purposes of this section, “private property open to the public” shall include
but not be limited to any parking lot, sidewalk, and empty lot. D. This section shall not apply to the sale of an animal that occurs: 1. On private property not open to the public; 2. At legally permitted pet shops and kennels; or
3. At or through any humane society, animal welfare society, society for the prevention
of cruelty to animals, or other nonprofit organization devoted to the welfare, protection, and humane treatment of animals. Section 2. Amendment. Moses Lake Municipal Code Section 6.18.020 titled “Penalty” is hereby
amended to read as follows:
6.18.020 Penalty. Failure to comply with any provisions of this chapter other than sections identified in MLMC 6.18.010 shall subject the violator to the following penalties as they are defined in
Chapter 1.08 of this code:

Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. If any clause, sentence, paragraph, subdivision, section, subsection or portion of this ordinance, or the application thereof to any person or circumstance, is held to be invalid, it shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances.
Section 4. Corrections. The City Clerk and the codifiers of this ordinance are authorized by the Moses Lake City Council to make necessary clerical corrections to this ordinance including, but not limited to, the correction of scrivener’s/clerical errors, references, ordinance numbering, section/subsection numbers, and any references thereto which do not change the substantive meaning of the ordinance.
Section 5. Effective Date. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law. ADOPTED by the City Council of the City of Moses Lake, Washington and signed by its Mayor
on October 8, 2024.

Staff is requesting that City Council approve the attached Ordinance adopting the September 20, 2025 Hearing
Examiner Recommended Findings of Fact, Recommended Conclusions of Law, Recommended Conditions of
Approval and Recommended Decision for the Maple Ridge Planned Development District (PLN2024-0056)
allowing for the development of a 202-lot Planned Development District to Construct Single-family dwelling units
and two tracts to construct multi-family dwellings.
Per Moses Lake Municipal Code the City Council has the following options when making a decision on the
proposed Planned Development District:
B. Decisions. The City Council shall make its decision by motion, resolution, or ordinance as appropriate.
1. A Council decision on a Planning Commission or Hearing Examiner recommendation or following a public
hearing shall include one (1) of the following actions:
a. Approve as recommended.
b. Approve with additional conditions.
c. Modify, with or without the applicant’s concurrence; provided, that the modifications do not:
1) Enlarge the area or scope of the project.
2) Increase the density or proposed building size.
3) Significantly increase adverse environmental impacts as determined by the responsible official.
d. Deny (reapplication or resubmittal is permitted).

Overview
On May 10, 2024, the City of Moses Lake Community Development Department received an application for a
Planned Development District and Preliminary Major Subdivision (Case No. PLN2024-0056). According to the
application materials, the project includes a proposal to subdivide a forty-acre parcel into 204 lots for single
family residential development with two tracts reserved for multi-family residential development. The parcel
(number 110475037) is located at the terminus of Maple Dr between Sequoia and Ray Rd. The subject site is
located within the R3-Multifamily Residential Zone.
Exhibit C depicts the layout of the lots and tracts. This request requires approval of the Preliminary Major
Subdivision by the Hearing examiner, and a recommendation from the Hearing Examiner to City Council
regarding the Preliminary Planned Development District, with adoption of an ordinance by City Council.
e. Deny with prejudice (reapplication or resubmittal is not allowed for one (1) year).
f. Remand for further proceedings and/or evidentiary hearing in accordance with Section 20.09.080. (Ord. 2949,
4/14/20; Ord. 2105, 12/23/02)
Because this is a closed record hearing, if Council desires to wait for the results of the Traffic Impact Analysis
before making a decision, it is recommended that the Case be remanded to the Hearing Examiner to take
further evidence.

Public Works Traffic Impact Analysis Memo
On September 10, 2024, a public hearing was held before the Hearing Examiner to consider the associated
applications in accordance with Moses Lake Municipal Code (MLMC) 18.67.090 for recommending an action to
the City Council to approve, conditionally approve, or deny the permit. On September 20, 2024, the Hearing
Examiner rendered a decision of approval for the Major Subdivision application, and simultaneously issued a
recommendation of approval to the City Council for the Planned Development District request that is being
considered tonight. Pursuant to City of Moses Lake Code 18.67.110 City Council Action, pursuant to Sections
20.09.030 and 2.08.100, the City Council shall consider and adopt or reject the ordinance with respect to the
recommendations of the Hearing Examiner. The Hearing Examiner’s September 20, 2024, Recommended
Findings of Fact, Recommended Conclusions of Law, Recommended Conditions of Approval and
Recommended Decision is included as Exhibit B. The documents outline the facts of the case and further
describes the basis for a decision to recommend approval of the Planned Development District.

AN ORDINANCE CREATING A PLANNED DEVELOPMENT (MAPLE RIDGE) DISTRICT OF MOSES LAKE PURSUANT
TO MOSES LAKE MUNICIPAL CODE 18.67
Recitals:
1. The purpose of the planned development district ordinance is to allow some flexibility in the design of clustered residential, commercial, or industrial uses with sufficient and
appropriate collective open space or a mixture of such uses by permitting specific
modifications of the bulk and use regulations and performance standards of the underlying zone(s) as applied to a particular parcel of land.
2. A planned development district is a floating district. Each approved planned development district is superimposed on the underlying zone to the extent that the planned
development district shall modify and supersede the bulk and use regulations and
performance standards of the underlying zone.
3. A planned development district encourages flexibility in design and development that will result in a more efficient and desirable use of the land.
4. Whereas, a planned development district permits flexibility of design, placement of
buildings, use of required open spaces, circulation facilities, open spaces, off-street
parking areas, and otherwise to better utilize the potentials of the site characterized by special features such as but not limited to geography, topography, or shape.
5. A planned development district provides for maximum efficiency in the layout of streets, utilities, and other public improvements.
6. A planned development district produces an integrated or balanced development of
mutually supportive uses that might be otherwise inharmonious or incongruous.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS:

Section 5. Severability. If any section of this ordinance is found to be unconstitutional or

Section 6. Effective Date. This ordinance shall take effect and be in force five (5) days after
its passage and publication of its summary as provided by law.

Re: Information on Maple Ridge Transportation Impact Analysis
A transportation impact analysis, or TIA, is a study of the potential transportation impacts of a
development on the surrounding transportation system. The purpose of the study is to
document the impacts and recommend on-site and off-site mitigation for those impacts.
Proportional cost share of mitigation is then evaluated and assigned to developer as condition of
development approval.
The City of Moses Lake’s Public Works Department reviewed and provided input regarding the
proposed development known as Maple Ridge.
Due to the proposed site of Maple Ridge lying within a vein of city limits and accessible only via
County & State facilities & jurisdictions (roads & right-of-way), the city was limited in what could
be requested to be studied in a Transportation Impact Analysis. City Staff requested developer
align their proposed subdivision streets with county roads and provided a planned streets map
showing the creation of grid connections which would allow better access & circulation to, from
& near proposed subdivision site. When WSDOT requested a TIA for their facilities a regional
scoping meeting was scheduled.
City staff organized a meeting with applicant Hayden Homes, Engineer WPE, WSDOT and
County staff to discuss scope of Analysis.
Requests:
WSDOT requested impacts be studied on State intersections near site SR17/Stratford Road,
SR17/Grape Drive
County requested impacts be studied on County intersections Patton Blvd & Harris Road, Maple
Drive & Grape Drive (suggesting possible Compact Roundabout) and Maple Drive and Stratford
Road. County plans to rebuild Maple Drive between Stratford Road and Grape Drive and
portions of Grape Drive with a federal Grant.

City requested additional road connections along East side of site & safe routes to school
concerns be analyzed. Multimodal analysis of bus routes & trails were also mentioned.
The TIA has not yet been completed at the time of this memo.
Concerns:
Please be aware, artificial lines on maps and the lack of interagency agreements/unified
standards, leave us unable to properly address growth and concerns easily & collectively.
Slowly, staff has worked towards breaking down silos. Historically, efforts have been duplicated,
ignored, forgotten or wasted due to varying priorities, jurisdictional authority and staff turnover.
Transportation Impact Analysis studies often add time and cost to projects and may not lead to
detailed outcomes or proportional costs / funds to implement needed improvements to county,
state or city transportation networks.
Solutions:
A regional approach is necessary to be able to address growth in our area. Discussions have
begun to determine if Quadco our RTPO (Regional Transportation Planning Organization) that
covers 4 counties, can provide support or if a COG (Council of Governments) is needed to unify
efforts and outcomes.

Proposed Change to MLMC 12.36.020 and 080
Overview
Changes to MLMC 12.36.020 include a new definition for Activity Trails and removes lists of park names to eliminate need for continuous Code updates.
Currently under MLMC 12.36.080, officers are authorized to exclude subjects from a city park for “up to” 7 days
for any violation of rules or laws. A subsequent exclusion within one-year results in a mandatory 90-day period,
and a third exclusion would be for a mandatory 1-year period. If the exclusion is for a felony crime or weapon
offense the subject is excluded for one year. A subject that is excluded for a period longer than 7 days may
appeal directly to the City Manager. This means a second exclusion is automatically appealable.
In an effort to give officers more options in dealing with behaviors occurring in our parks, and to make the appeal
process less cumbersome, the Police Department proposes the addition of another exclusion step. The first
exclusion period would not exceed 3 days. The subsequent offenses would remain as "not to exceed" 7-days,
then 90 days, and 1 year exclusions for subsequent offenses within the year. The opportunity to appeal any
exclusion beyond 7 days would remain, but we suggest the appeal would be more appropriately heard by the
Parks, Recreation, and Cultural Services Director responsible for the parks where the exclusions would occur.
While a small change, we feel this extra exclusion step not only allow us more latitude in dealing with behaviors
but will also make any criminal enforcement of the State Criminal Trespassing statute more enforceable and
effective.
There is no additional costs associated with this. The additional level of exclusion before the appeal process is

Section 1. Section 12.36.020 of the Moses Lake Municipal Code titled “Park” is amended as
follows:
12.36.020 Identification of Parks:
Parks are identified as any existing or future city parks. The City will maintain a current list of
all parks accepted by City Council at the Parks Recreation and Cultural Services Administrative
Office. Parks shall be classified as “activity trails”, “passive” or “active” parks as follows
A. Activity Trails – A path of travel for recreation and/or non-motorized transportation within a park, natural environment or corridor that is not classified as a highway road or street.

12.36.080 Park Exclusion
A. The Police Chief or his/her designees may, by delivering an exclusion
notice in person to the offender, or by first class mail and certified mail to
the offender at the offender’s last known address, exclude from a city
park, anyone who within a city park:
1. Violates any provision of this chapter; or
2. Violates any park rule; or
3. Violates any provision of the Moses Lake Municipal Code or Revised
Code of Washington.
The offender need not be charged, tried, or convicted of any crime or
infraction in order for an exclusion notice to be issued or be effective. The
exclusion may be based upon observation by the Police Chief or his/her
designee or upon civilian reports that would ordinarily be relied upon by
police officers in the determination of probable cause.
B. If the offender:
1. Has not been excluded from any city park by an exclusion notice
issued within one year prior to the violation and the current violation is not
a felony violation or weapon violation, then the Police Chief or his/her
designee may exclude the offender from the city park in which the current
violation occurred for a period not exceeding seven three days from the
date of the exclusion notice.
2. Has been the subject of only one prior exclusion notice issued within
one year prior to the current violation and neither the current nor the past
violation was a felony violation or a weapon violation, then the Police
Chief or his/her designee shall exclude the offender from any or all city
parks for a period of ninety seven days from the date of the exclusion
notice.
3. Has been the subject of two or more prior exclusion notices issued
within one year prior to the current violation, or if the current violation is a
felony violation or a weapon violation, then the Police Chief or his/her

designee shall exclude the offender from any or all city parks for a period
of one year ninety days from the date of the exclusion notice.
4. Has been the subject of two or more prior exclusion notices issued within one year prior to the current violation, or if the current violation is a felony violation or a weapon violation, then the Police Chief or his/her
designee shall exclude the offender from any or all city parks for a period
of one year from the date of the exclusion notice.
C. The exclusion notice shall be in writing and shall contain the date of
issuance. The exclusion notice shall specify the length and places of
exclusion. It shall be signed by the issuing individual. Warning of the
consequences for failure to comply shall be prominently displayed on the
notice.
D. An offender receiving an exclusion notice longer than seven days may
seek a hearing to have the exclusion notice rescinded, the period of
exclusion shortened, or the areas of exclusion reduced. The hearing
examiner shall be the City Manager Director of Parks Recreation and
Cultural Services. The request for a hearing shall be delivered to the
Police Chief or postmarked no later than seven days after the issuance date
of notice. The request for hearing shall be in writing and shall be
accompanied by a copy of the exclusion notice on which the hearing is
sought. The hearing should occur within seven days after the Police Chief
receives the request for hearing. The Police Chief or his/her designee shall
take reasonable steps to notify the offender of the date, time, and place of
the hearing.
E. At the hearing, the violation must be proved by a preponderance of the
evidence in order to uphold the exclusion notice. If the exclusion notice
was issued because of the alleged violation of any criminal law, the
offender need not be charged, tried, or convicted for the exclusion notice
to be upheld. The exclusion notice establishes a prima facie case that the
offender committed the violation as described. The hearing examiner shall
consider a sworn report or a declaration made under penalty of perjury,
written by the individual who issued the exclusion notice, without further
evidentiary foundation. The certifications authorized in Rule 6.13 of the
Criminal Rules for Courts of Limited Jurisdiction shall be considered

without further evidentiary foundation. The hearing examiner may
consider information that would not be admissible under the evidence
rules in a court of law but which the hearing examiner considers relevant
and trustworthy.
F. If the violation is proved, the exclusion notice shall be upheld; but upon
good cause shown, the hearing examiner may shorten the duration of the
exclusion or reduce the areas covered by the exclusion. If the violation is
not proved by a preponderance of the evidence, the hearing examiner shall
rescind the exclusion. If the hearing examiner rescinds an exclusion, the
exclusion shall not be considered a prior exclusion for purposes of
subsection B of this section.
G. The decision of the hearing examiner is final. An offender seeking judicial
review of hearing examiner’s decision must file an application for a writ
of review in the Grant County Superior Court with fourteen days of the
date of that decision.
H. The exclusion shall remain in effect during the pendency of any
administrative or judicial proceeding.
I. No determination of facts made by a person conducting a hearing under
this section shall have any collateral estoppel effect on a subsequent
criminal prosecution or civil proceeding and shall not preclude litigation
of those same facts in a subsequent criminal prosecution or civil
proceeding.
J. This section shall be enforced so as to emphasize voluntary compliance
with laws and park rules, and so that inadvertent minor violations that
would fall under subsection B.1 can be corrected without resort to an
exclusion notice.
Section 3. This ordinance shall take effect and be in force five (5) days after its passage and
publication of its summary as provided by law.

I. INTRODUCTION
The City of Moses Lake is committed to providing the highest levels of service to the
community and recognizes the value of employees who can communicate with
customers in languages other than English.
This policy applies to regular full-time and part-time non-bargaining unit employees.
Regular part-time employees may be eligible for a pro-rated benefit. Employees
occupying temporary positions are not eligible for bilingual incentive pay. Represented
employees will be guided by the applicable collective bargaining agreement.
II. EMPLOYEE ELIGIBILITY
Budgetary restraints may limit a department’s ability to authorize all requests for
bilingual incentive pay. Therefore, the city retains the right to test and incentivize
employees based on the needs of the organization. Other eligibility requirements
include:
A. Employees must hold a public facing position and regularly use a second
language in the performance of their essential job functions.
B. Employees who use their bilingual skills on an incidental or occasional basis or for
work done outside of the employee’s essential duties are not eligible for this
benefit.
C. Employees must pass language proficiency testing as selected and
scheduled by Human Resources.
D. Employees who fail language proficiency testing may retest after twelve (12)
months.
E. If an employee moves to a position that does not benefit from language
services, they will no longer be eligible to receive bilingual incentive pay.

III. REQUESTING PROCEDURE FOR BILINGUAL DESIGNAGTION FOR THE POSITION:
A. Departments shall request a bilingual designation by providing written
justification to Human Resources. The justification should describe the need
and the nature and frequency of bilingual duties.
B. Human Resources may designate occupied positions as bilingual, even if the
incumbent does not have bilingual skills.
C. Applicants or incumbents for a bilingual designated position must pass a
bilingual proficiency test to be eligible for bilingual incentive pay. Human
Resources will schedule the employee for testing.
D. Departments may request a bilingual designation to be removed from a position
by providing written justification of requested change.
E. Once an employee passes their proficiency testing and becomes eligible for
bilingual incentive pay, their supervisor will work with Human Resources to
submit a PAF. Upon PAF approval, the employee will begin receiving bilingual
incentive pay effective the first day of the following pay period.
IV. EMPLOYEE RESPONSIBILITIES
A. Employees receiving bilingual incentive pay are expected to primarily provide
language services that are included in their essential functions or assist with
other interpretations provided this does not interfere with their daily work.
Employees should not be providing services that are out of the scope of their
position or experience.
B. Employees receiving bilingual incentive pay who are not certified to provide
written translation services must not translate documents for their department
or others.
C. Employees who have not qualified for bilingual incentive pay should not be
providing interpretations and should instead use the city’s approved language
line.
D. Employees receiving bilingual incentive pay are not required or expected to
provide language services outside of their normal working hours.
V. BILINGUAL INCENTIVE PAY
Employees who are appointed to serve in bi-lingual interpreter status will receive
seventy-five dollars ($75.00) per month.

This Staff Report sets forth the results of the analysis completed of comparing the City of Moses
Lake’s stipends for Mayor, Deputy Mayor, and Council Member with that of the comparable cities that
share our Council-Manager form of government.
Per MLMC 2.60, Stipends for Mayor and City Council Members, “The stipend paid to the Mayor, Deputy Mayor,
and City Council Members shall be reviewed by the City Council and adjusted, if appropriate, between June and
December of each even numbered year.”
(Note: Any approved stipend adjustments must be voted on by the City Council prior to an election
cycle in odd-numbered years. Approved adjustments will go into effect at re-election of a current
Council Member or election of new Council Member to a position.)
The analysis found that three (3) of the comp. cities used have Council-Manager form of government:
Ellensburg, Walla Walla, Port Angeles. The average monthly compensation for Mayor and Councilmember is as
follows:
Mayor - $1,266.67
Councilmember - $866.67
There were no specific comps. for Deputy Mayor.
City of Ellensburg - Mayor - $1,000/month
City of Walla Walla - Mayor - $1,500/month
City of Port Angeles - Mayor - $1,300/month
City of Ellensburg - Councilmember - $500/month
City of Walla Walla - Councilmember - $1,000/month
City of Port Angeles - Councilmember - $1,100/month
The City of Moses Lake currently provides for the following monthly compensation:
Mayor - $1000
Deputy Mayor - $600
Councilmember - $500
The City of Moses Lake also provides $30/meeting (max. of 10 meetings/month) to Mayor, Deputy Mayor and
Councilmember.
Dependent upon approved option.
Options and Results
If Council wishes to maintain current rates, council will continue to receive the current amounts set forth in the
municipal code.
Council may establish a Salary Review Commission for further analysis in accordance with RCW 35.21.015.
Staff will bring back options for recommended changes.
Current stipends would remain in effect.

1026 W. Edgewater Lane, Moses Lake, WA 98837. Raul Jimenez &
Candice Vicki Figueroa.

In reference to the Council meeting of 9-24-2024 and the complaint related to the home
occupation business of jet skis at the address listed herein. Code Enforcement staff has
investigated and addressed this compliant having the following clarifications and
information to offer:
Complainant:
•Complaint initially indicated on June 23, 2021, regarding a jet ski business being
operated out of the home and is creating noise which is not conducive to the
residential use of the area. See below. And another complaint regarding the same
situation at the Council meeting on 9-24-2024.
Code Enforcement Response:
•There is an approved home occupation business for this location.
•On 06-23-2021 and subsequent dates listed below, Code Enforcement staff
investigated similar complaints at the property based on allegations by the same
complainant that the jet skis located at the property are part of the business and
that said jet skis are being worked on or repaired at the home location.
•On 06-23-2021 Code Enforcement staff investigated and contacted the owner of
Affordable Jet Ski Rental, Raul Figueroa, and explained the compliant received
about his business and advised he needed to obtain a city business license along

with a Home Occupation License and to cease the rental of jet skis from his
residence. Figueroa was also advised the storage of the business jet skis is not
allowed at the property.
• The owner, Raul Figueroa had the following response: Figueroa stated he
understood and apologized and did not want to do anything to jeopardize his
business. Figueroa requested a weeks’ time frame to secure an off-site location to
store the jet skis. Figueroa also stated he has personal jet skis for he and his
family which are separate from his business. Figueroa indicated the personal and
business jet skis are different make, model and colors in which he described.
• On 06-28-2021 – Owner of Affordable Jet Ski Rental, Raul Figueroa applied for a
Home Occupation License.
• On 07-15-2021, a re-check of the property was conducted and the (4) business jet
skis and trailer were removed from the property. It was confirmed on this date that
Figueroa was in the process of obtaining a city business license and Home
Occupation License.
• On 07-06-2022- Code Enforcement staff responded to a complaint of jet ski rental
and repair being conducted at the home of 1026 W. Edgewater. Staff contacted
Vicki Figueroa who confirmed they have an off-site location in the county for the
jet skis. Figueroa stated they have a large family with personal jet skis and boats,
and they utilize and maintain their personal watercraft at the house. I cautioned
Figueroa about only minor repairs can be done on vehicles and such. I confirmed
with Figueroa that no repairs to the business jet skis are conducted at the
residence. Complaint unfounded.
• On 07-10-2023 – Code Enforcement staff responded to a complaint of jet ski
rental/repair and noise being conducted at 1026 W. Edgewater. Complaint
unfounded.
• On 08-01-2023 - Code Enforcement staff responded to a complaint of jet ski being
purchased/repaired and sold and noise coming from 1026 W. Edgewater. Raul
Figueroa indicated they have purchased personal watercraft and then sold to buy
different ones for their personal use. Figueroa indicated the noise was possibly
coming from his son who edged the lawn earlier in the day. No noise at the time of
contact. Complaint Unfounded.

• On or about 09-12-2024, Code Officer Nevarez responded to the location based
off a complaint and inquired the location in the county where the jet skis are
stored. Nevarez responded to the location and observed the business jet skis at
the stated location. Complaint Unfounded.
Owners Response:
The owner is very cooperative when contacted by code enforcement staff and after the
initial contact in 2021, the owner has revised his business plan to address the jet skis to
be off-site.
• The owner secured a property location in the county where the jet skis are stored
off site and when rented via phone or other means are delivered directly to the
renter at the lake or as otherwise arranged.
• Since the original complaint, no rented equipment is being stored at the home, the
home is being used for administration of the business, i.e. taking rental orders,
maintaining the books.
Code Enforcement Response:
• Code Enforcement staff has continued communication with the business owner
and identified any jet skis on site after the business revisions have been made are
those which personally belong to the occupants and business owner’s family; they
are exclusively for “personal use” only and are not party to the rented jet skis. If
the complainant sees jet skis being parked, stored or worked on for general
maintenance, they are not business-related equipment according to the property
owner. Code Enforcement has confirmed the business and personal use jet skis
are different make, model and colors.
Code Enforcement Post-Complaint Action:
• Code Enforcement staff periodically monitors this property due to the nature of the
continuous complaints and finds no violations. Currently there are no open and
active cases for 1026 W. Edgewater.
In conclusion, it is the determination of the Code Enforcement staff and the Building
Official that there are currently no violations of the home occupation business as granted
by the City of Moses Lake.
