3988 Set PH Clements ROW VacateRESOLUTION NO. 3988 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY DEDICATED FOR THE DEVELOPMENT OF AN ALLEY IN THE LEWIS ELLIOTT ADDITION NO.2 ADJACENT TO LOTS FIVE AND TWELVE AND GRANT COUNTY ASSESSOR’S PARCEL NUMBERS 1011315000 AND 101309000. Recitals: 1. There exists right-of-way dedicated for the development of an alley in the Lewis Elliott Addition No.2 adjacent to lots five and twelve and County Assessor’s Parcel Numbers 1011315000 and 101309000. 2. RCW 35.79 provides that a public street or alley may be vacated upon resolution initiated and passed by the legislative authority of the jurisdiction where the street or alley is situated and that such resolution shall fix a time when the petition will be heard and determined, and which shall not be more than sixty dates nor less than twenty days after the passage of such resolution. Resolved: 1. The vacation of the following described public right-of-way shall be initiated: That portion of the city alley right of way between West Broadway (Marina Dr.) and Third Avenue, described on the plat of Lewis Elliot Addition No.2 recorded March 17, 1954, recorded under Grant County Auditor's File Number 218583; All of said city street right of way is located in the Section 22, Township 19 North, Range 28 East, W.M., City of Moses Lake, County of Grant, State of Washington as shown on the attached Exhibit 'B' and is more generally described as follows: The North half of Alley abutting lot 5 Lewis & Elliot Addition according to the plat recorded in volume 5 of plats @page 27 The South half of Alley abutting lot 12 Lewis & Elliot Addition according to the plat recorded in volume 5 of plats @page 27 Document Ref: V58FH-ZEUWF-OHRXR-QZFPQ Page 1 of 5 SUBJECT TO: 2.
