RESOLUTION NO. 3992
A RESOLUTION FIXING AND LEVYING THE AMOUNT OF AD VALOREM TAXES NECESSARY TO
DISCHARGE THE EXPECTED EXPENSES AND OBLIGATIONS FOR THE 2025 BUDGET FOR THE CITY OF
MOSES LAKE
Whereas, RCW 84.52 requires the governing body of the City of Moses Lake to fix the estimated amount
to be raised by taxation on assessed valuation on property within the City of Moses Lake; and,
Whereas, the City of Moses Lake’s highest actual levy amount occurred in 2024 and was
$10,745,369.26; and
Whereas, the City is allowed by law to increase its tax levy by 1% over the highest levy amount it has
ever received since 1985, which would establish a limit of $10,852,822.95; and
Whereas, the City of Moses Lake’s actual levy amount from the previous year, 2024, was $9,372,175.69;
and
Whereas, the City intends to levy " banked capacity" of $422,000.00; and
Whereas, the City of Moses Lake, has a population of more than 10,000; and
Whereas, a Public Hearing was held, with notice duly provided, to consider the City’s current expense
budget for the 2025 calendar year pursuant to RCW 84.55.120; and
Whereas, the City Council of the City of Moses Lake, after hearing and duly considering all relevant
evidence and testimony presented, has determined that the City of Moses Lake requires an increase in
real property tax revenue from the previous year, resulting from the limit factor, and an increase of
$422,000.00 of banked capacity from the previous year along with the addition of recent annexations,
new construction and improvements to property and any increase in the value of state-assessed
property and refunds made, in order to discharge the expected expenses and obligations of the City;
now, therefore
BE IT RESOLVED BY THE CITY OF MOSES LAKE CITY COUNCIL:
Section 1. The following increases in the regular property tax levy, over the amount of the previous
year’s levy, are hereby authorized to be cumulatively levied for collection in 2025:
A. A discretionary increase of $107,454, attributable to the inflation factor which is a
percentage increase of 1.0% over the highest amount levied for collection since 1985 which
was $10,745,369 in 2024; plus
B. An estimated increase of $277,208 for new construction and improvements to property; plus
C. An increase authorized by state law for state-assessed property values; plus
D. An estimated increase of $78,026 due to re-levying for any refunds and cancellations/
supplementals made in the previous year, plus
E. An increase of $422,000 of banked capacity from previous years. The discretionary increase
and the banked capacity increase will result in an overall increase of 5.649% and a resolution
increase amount of $529,454 to be used for calculating page 2 of the levy limitations
worksheet.

Section 2. There is hereby fixed to be raised by general property taxes upon real and personal property
within the City of Moses Lake, for the year of 2025, the sum of $10,206,864 for general municipal
purposes, including Firemen’s Relief and Pension.
Section 3. The City Clerk is directed to transmit and file a certified copy of this resolution with the Board
of Grant County Commissioners and the Grant County Assessor on or before November 30, 2024.
Section 4. This resolution shall take effect January 1, 2025.
ADOPTED BY THE CITY COUNCIL, and signed and approved this 12th day of November 2024.

Conduct the first Public Hearing for the 2025 budget.
The budget provides for the financial planning, control, and evaluation of all funds. The City Manager and all
Department Directors met to review budget proposals, and a proposed 2025 budget was presented to City
Council at a budget workshop held on October 5,2024. At Council's direction, additional meetings were
conducted following the first budget workshop on October 23rd and October 31st. Recommended changes from
the budget workshops have been included in the preliminary budget.
This is the first presentation of the 2025 Preliminary Budget. The budget requires two public hearings be held
before adoption of the budget ordinance establishing the authorization and spending plan for the 2025 fiscal
year for all City operations. Any further recommendations resulting from the first presentation of the budget from
Council will be made and incorporated into the 2025 Preliminary Budget. A second public hearing is scheduled
to be held on November 26, 2024.
For the 2025 Preliminary Budget, all funds are balanced within available resources. Additional explanation and
summaries of revenues and expenditures by fund are included in a separate 2025 Preliminary Budget
document.

The total proposed 2025 preliminary budget is roughly $119.6 million with the General Fund operating budget
amounting to $41.8 million. All funds are balanced within available resources (i.e., new revenues and reserves).

ORDINANCE XXXX
AN ORDINANCE VACATING THE ALLEY/RIGHT-OF-WAY LOCATED BETWEEN PARCELS 101315000 & 101319000.
WHEREAS, the City of Moses Lake has received a petition requesting the vacation of right of
way of unimproved alleyway in conjunction with a boundary line adjustment-lot consolidation completed on 01/03/2023. WHEREAS, the City Council has adopted a resolution setting a public hearing to consider the
petition, fixing the date and time as November 12, 2024, at 6:30 pm, in the Council Chambers.
WHEREAS RCW 35.79.030 authorizes the city to vacate any street, or alley, or any part thereof, and that the city be compensated for full appraised value of public right-of-way that has been dedicated for more than twenty-five years.
WHEREAS the alley/right-of-way was dedicated to the public in 1952 via the Lewis & Elliott Addition.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS
FOLLOWS: Section 1. The following described public right-of-way shall be vacated:
That portion of the city alley/right of way described as vacant alley located directly to the south of the parent parcel (101315000), 20 ft by 140 ft. The north half of Alley abutting Lot 5 Lewis & Elliott Addition, and the South half of Alley
abutting Lot 12 Lewis & Elliott Addition according to the plat recorded in volume 5 of plats at
page 27. Containing 2,800 sf (20’ x 140’)
Section 2. The City shall be compensated for the full appraisal price of the vacated property. The
vacation shall not become effective until the required compensation is received by the City. Section 3. Severability. If any section of the ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of the ordinance shall
be deemed to be invalid, but rather, should be deemed to have been enacted independently and
without regard to the section affected.

Section 4. Effective Dave. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law.

The regular meeting of the Moses Lake City Council was called to order at 6:30 p.m. by Mayor
Swartz in the Council Chambers of the Civic Center with audio remote access. Special notice for
remote attendance and citizen comment were posted on the meeting agenda.

Action taken: Council Member Skaug moved to approve the Agenda as presented, second by

PRESENTATION
Faith Based Transitional Housing
Joseph Moriarty and Caleb Altemeyer provided handouts at the meeting with details on the
Jacobs Well Outreach programs called Helping Captives and Project Return Home.
CITIZEN’S COMMUNICATION
Homeless - Moses Lake residents Linda Bishop and Judy Ferguson expressed concerns of illegal
activity taking place behind the movie theaters. Council and staff advised that the private
property owners are cooperating for trespassing orders and clean-up will commence next week.
Pickleball Budget Request – Moses Lake residents Richard Teals and Jaime Garza requested
$20k be approved for the purchase of pickleball nets and resurfacing courts in 2025. The amount
of $10k for the resurfacing was discussed at the PRCS Committee meeting on October 15.

Native American Heritage Month Proclamation
In accordance with RCW 28A.320.170 for tribal history recognition, Mayor Swartz
proclaimed November 29 as Native American Heritage Day and November as Native
American Heritage Month.
Veteran’s Day Proclamation
Mayor Swartz read a proclamation to declare and honor Veteran’s Day on November 11 and
thanked Veterans in attendance for their service.

Community Development New Hires
Interim Community Development Director Vivian Ramsey provided a brief biography on
recent hires William Mumma Building Inspector II and Building Inspector III Chris Horton.
AWC Legislative Priorities
State Legislatures will meet in Olympia from January 13 to April 27, 2025. Several Council
were wondering about including only some of the items from the AWC Legislative Priorities
in the Local Priorities as well as discussing regional priorities with the Association of Grant
County Cities and Towns (AGCCT). Council requested staff issue a quick solicitation on
Request for Proposals for state lobbying services.

OLD BUSINESS
#2 Parks Exclusion and Identification Amendment Ordinance 3057
The proposed changes were first presented on October 8 to add a definition for Activity
Trails, eliminate names of parks, add a ’3-day exclusion’ period, and change appeals to
the Parks Director. City Attorney Anna Franz provided revised language to the Parks
Exclusion section 12.36.080(B)(4).
Action taken: Council Member Martinez moved to adopt Ordinance 3057 for revised park
exclusion changes as amended, second by Deputy Mayor Madewell. The motion carried 7 – 0.
#3 LKQ Development Agreement Ordinance 3058
This ordinance will repeal and replace ordinance 3049 adopted on August 27, the only
change being an extension to the deadline to November 30, 2024.
Action taken: Council Member Fancher moved to adopt Ordinance 3058 as presented, second by
Council Member Lombardi. The motion carried 7 – 0.
NEW BUSINESS
#4 Lodging Tax Advisory Committee (LTAC) Application Approvals
The LTAC members received presentations from the 2025 Applicants on October 3.
They met the following week to review the available funding and finalize their
recommendation of awards to Council for a total of $650,910. The committee will meet

again in the spring to determine if there is value in renewing the Datafy Software.
Action taken: Mayor Swartz moved to authorize the 2025 Lodging Tax Funds as presented,
second by Council Member Skaug. The motion carried 7 – 0.
#5 MLMC Water and Sewer Reimbursement Repeal Ordinance 3059
Staff presented an ordinance to remove items in the Code that have exceeded the 20- year
statute of limitations for utility improvements in accordance with RCW 35.91.020.
Action taken: Council Member Martinez moved to adopt Ordinance 3059 as presented, second
by Council Member Lombardi. The motion carried 7 – 0.
#6 Revised Sleep Center Management Contract
Council approved the contract extension with HopeSource through September 2025 on
July 23, 2024. Staff at HopeSource are requesting updated language for intake, reporting,
ADA, and termination period. Council discussed concerns in the gap of coordinated
social services and will provide staff with a list of criteria they would like to see reported.
Action taken: Council Member Martinez moved to authorize the contract amendment as
presented with an emphasis on accountability and reporting, second by Council Member Myers.
The motion failed 5 – 2. Mayor Swartz, Deputy Mayor Madewell, Council Members Skaug,
Fancher, and Lombardi were opposed.
ADMINISTRATIVE REPORTS
Monthly Update on Excess Water Usage Fee
Finance Director Madeline Prentice advised that the number of accounts charged an
excess usage in August dropped by 50 from the prior month, 33 residential and 17
irrigation customers. Staff are working on an advance notice packet for the installation of
new smart meters. The Water Resource Committee will be presenting options to utilize
the excess funding on November 19.
COUNCIL COMMUNICATIONS AND REPORTS
Council Members Myers and Martinez attended the Council’s Ad Hoc Homeless Committee
where they talked about required ADA upgrades at the sleep center facility. They also suggested
inviting HopeSource to a meeting to further discuss the requested contract amendments.
Council Member Martinez shared that the Watershed Council is working with staff to get homes
on Westshore Dr. off septic. She also voiced interest in seeking reappointment to Grant County
Board of Health through the AGCCT recommendation.
Council Member Fancher stated that the hot topic at the Public Works Committee meeting today
was the new Grant County PUD property and interest in annexation.
Council Member Lombardi provided an update on the Port of Moses Lake rail project.
Mayor Swartz attended the Chamber of Commerce annual meeting last week, AGCCT will have
a presentation from the Grant County Economic Development Council (EDC) next week, and the

EDC is hosting the Grant County LEAD Summit on November 14th.

The City of Moses Lake and the Grant County Health District (GCHD) have had an Interlocal Agreement in
place since 2005 in which the City provides financial contribution to the GCHD and in turn the GCHD provides
public health services.
The GCHD requested the City provide funding in the amount of $3.00 per capita, which equals $80,000.00
annually and an updated signed ILA with the City. The City budgeted the requested amount in the 2024 budget,
and with council's approval, asks that the city manager be authorized to sign the updated ILA.
The requested amount is in the proposed budget for 2025.
Options and Results
Staff will execute the interlocal agreement with the Grant County Health District.

INTERLOCAL AGREEMENT
BETWEEN THE GRANT COUNTY HEALTH DISTRICT
AND
THE CITY OF MOSES LAKE
PER CAPITA CONTRIBUTION FOR HEALTH DISTRICT SERVICES
This Interlocal Agreement for Per Capita Contribution for Health District Services is entered into by and
between the GRANT COUNTY HEALTH DISTRICT, a Washington Municipal Corporation (the District)
and CITY OF MOSES LAKE a municipal corporation of the State of Washington (the City) – collectively
(the Parties), for the purpose of providing for a per capita contribution by the City for Health District
Services.
RECITALS
WHEREAS, This Agreement is made pursuant to the Interlocal Cooperation Act, Chapter 39.34
RCW; and
WHEREAS, to promote the public health in Grant County, Washington, the Board of County
Commissioners of Grant County, Washington, established a Health District on in 1967, embracing all of
the territory within Grant County, Washington, and all cities and towns therein; and
WHEREAS, in 1967 the Grant County Health District became a public health program with cities
indicating a willingness to participate on the Grant County Board of Health; and
WHEREAS, in 1993, counties assumed exclusive financial responsibility for public health relying
on Motor Vehicle Excise Tax (MVET) revenues; and
WHEREAS, in 2000, the Washington State Legislature repealed MVET and backfilled only 90%
of lost public health funds; and
WHEREAS, on January 1, 2005, 7 of 14 cities and towns agreed to voluntarily contribute $1.00
per capita to the Health District in return for public health services; and
WHEREAS, prior to the COVID Pandemic, 12 of 13 cities and towns agreed to voluntarily
contributed $1.00-$4.00 per capita to the Health District in return for public health services; and
WHEREAS, in 2024 Grant County Board of County Commissioners contributed $171,910 and
Grant County cities and towns voluntarily contributed $154,095 to the Health District in return for public
health services; and
WHEREAS, the Health District’s ability to perform its most essential functions have been severely
compromised since the great recession; and
WHEREAS, the Health District serves an essential public safety function whether ensuring safe
food, schools, and septic systems, responding to disasters, or preventing and responding to disease
outbreaks; and
WHEREAS, threats to the public’s health in the form of foodborne illness such as E. coli and
salmonella, communicable diseases such as pertussis, tuberculosis, measles, and Ebola and natural
disasters such as response to annual wildfire smoke respect no municipal boundaries; and
WHEREAS, public health is a shared responsibility and regional public health threats require
regional responses and close partnerships with every city and town in Grant County; and
WHEREAS, consistent with RCW 70.05, the Grant County Board of County Commissioners is
responsible for establishing the Grant County Board of Health, with jurisdiction coextensive with the

boundaries of the county, to supervise all matters pertaining to the preservation of life and health of the
people within its jurisdiction; and
WHEREAS, an effective, regional public health response to the threats to public health in Grant
County requires the cooperation, participation and support of Grant County and all of the cities and towns
in Grant County; and
WHEREAS, Grant County and the cities and towns therein seek to improve and sustain healthy
years of life of their residents by engaging in an enhanced partnership with the Health District. This
partnership will provide stable funding for public health priorities that would be established to meet the
unique needs of each community.
NOW, THEREFORE, in consideration of the agreements set forth below and for other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the City and the Health
District agree as follows:
1. Purpose.
A. The recitals set forth above are incorporated herein by this reference.
B. The purpose of this Agreement is to establish and define the terms and conditions for the
cooperative efforts to be undertaken by the City and the Health District to promote,
facilitate, and undertake various programs and activities.
2. Term.
The term of this Agreement shall be from January 1, 2025, to December 31, 2025. The term may
be extended by mutual written agreement of the parties.
3. Scope of Services.
A. Responsibilities of the City.
The City shall contribute $3.00 annually to the Health District commencing January 1,
2025. Payments may be made in one lump sum annually, preferably on or before June
30 of each year.
B. Responsibilities of the Health District.
An invoice will be sent to the city after the first of the year.
The Health District shall provide basic essential public health services and functions such
as ensuring safe food, inspecting septic systems, responding to disasters, or preventing
and responding to disease outbreaks.
The Health District will partner with the City to coordinate childhood injury prevention,
substance use related training, and community outreach events.
The Health District will provide reports to the city identifying services provided to City
residents and businesses.
Additional specific services provided by the Health District to the City may be developed
jointly by the parties.
4. Legal Requirements.
Both parties shall comply with all applicable federal, state, and local laws in performing this
Agreement.
5. Public disclosure laws.
The City and the District each acknowledge, agree, and understand that the other party is a
public agency subject to certain disclosure laws, including, but not limited to Washington’s Public

Records Act, chapter 42.56 RCW. Each party understands that records related to this Agreement
and the District’s performance of services under this Agreement may be subject to disclosure
pursuant to the Public Records Act or other similar law.
6. Insurance.
Each party shall maintain its own insurance and/or self-insurance for its liabilities from damage to
property and /or injuries to persons arising out of its activities associated with this Agreement as it
deems reasonably appropriate and prudent. The maintenance of, or lack thereof of insurance
and/or self-insurance shall not limit the liability of the indemnifying part to the indemnified party(s).
Each party shall provide the other with a certificate of insurance or letter of self-insurance upon
request.
7. Indemnification.
The District shall protect, save harmless, indemnify and defend the City its elected officials,
officers, employees and agents, from and against any loss or claim for damages of any nature
whatsoever, including claims by third parties or District employees against which it would
otherwise be immune under Title 51 RCW or other law, arising out of any act or omission of the
District in performance of this Agreement, its elected or appointed officials, officers, employees or
agents, except to the extent the loss or claim is attributable to the negligence or willful
misconduct of the City, its elected officials, officers, employees or agents.
The City shall protect, save harmless, indemnify and defend the District, its elected and
appointed officials, officers, employees and agents from and against any loss or claim for
damages of any nature whatsoever, including claims by third parties or City employees against
which it would otherwise be immune under Title 51 RCW or other law, arising out of any act or

8. Notices.

Receipt of any notice shall be deemed effective three (3) days after deposit of written notice in the

9. Venue.
The laws of the State of Washington shall apply to the construction and enforcement of this
Agreement. Any action at law, suit in equity, or judicial proceedings for the enforcement of this
agreement or any provision hereto shall be in the Superior Court of Grant County, Ephrata,
Washington.
10. Disputes.
The parties agree that, following reasonable attempts at negotiation and compromise, any
unresolved dispute arising under this Agreement may be resolved by a mutually agreed-upon
alternative dispute resolution of arbitration or mediation.

11. No third-party beneficiaries; no joint venture.
This Agreement is for the sole benefit of the City and District and shall not confer third-party
beneficiary status on any non-party to this Agreement. Nothing contained in this Agreement shall
be construed as creating any type or manner of partnership, joint venture or other joint enterprise
between the parties. Health District employees who provide services under this Agreement shall
at all times be acting in their official capacities as employees of Grant County Health District.
12. Entire Agreement.
This Agreement constitutes the entire agreement between the parties regarding the subject
matter hereof and supersedes any and all prior oral or written agreements between the parties
regarding the subject matter contained herein. This Agreement may not be modified or amended
in any manner except by written agreement executed by both parties. Both parties recognize that
time is of the essence in the performance and the provisions of this Agreement.
13. Severability.
A. If a court of competent jurisdiction holds any part, term or provision of this Agreement to
be illegal or invalid, in whole or in part, the validity of the remaining provisions shall not be
affected, and the parties’ rights and obligations shall be construed and enforced as if the
Agreement did not contain the particular provision held to be invalid.
B. If any provision of this Agreement is in direct conflict with any statutory provision of the
State of Washington, that provision which may conflict shall be deemed inoperative and
null and void insofar as it may conflict and shall be deemed modified to conform to such
statutory provision.
14. Filing.
As provided by RCW 39.34.040, this Agreement shall be filed with the Grant County Auditor, or,
alternatively, posted on the website of each party.
15. Execution in Counterparts.
This Agreement may be executed in two or more counterparts, each of which shall constitute an
original and all of which shall constitute one and the same agreement.
16. Effective Date. January 1, 2025

The Transportation Benefit District (TBD) enabling legislation in Washington State law has a requirement for an
annual report to the public indicating the status of the revenues and expenditures for the TBD (RCW
36.73.160(2)). The attached report details the revenues and expenditures of the TBD and streets repair and
reconstruction fund (fund 119) from 2019 to 2023.
TBD dollars are budgeted as part of the 119 Streets Repair and Reconstruction funds during the annual budget
process and through budget amendments during the fiscal year. This report summarizes actual project costs
over the stated period.

Transportation Benefit District Report
NOTICE IS HEREBY GIVEN that the City Council is issuing the Moses Lake Transportation Benefit District
2023 Annual Report to the Moses Lake residents.
The Moses Lake Transportation Benefit District (MLTBD) was created on December 27, 2016, in
accordance with RCW 35.21.225. The creation of the MLTBD established the boundaries as the entire
City of Moses Lake as it currently exists or any adjustment to the boundaries in the future. In November
2017, the citizens of Moses Lake approved a ballot measure authorizing the MLTBD to collect two tenths
of one percent sales tax for a period of 10 years. In December 2023, the council passed Ordinance 3041
imposing an additional one tenth of one percent sales tax collection for the TBD. As of April 1, 2024, the
City has been collecting the full 0.30% sales tax as allowed by the RCW.
Revenues from this tax are to be dedicated for the purposes of ongoing transportation improvements
that preserve, maintain and as appropriate, construct or reconstruct the transportation infrastructure of
the City of Moses Lake.
The MLTBD is governed by the City of Moses Lake Council. The MLTBD began receiving sales tax receipts
in April 2018.

Titan Data Center/RS Titan-Alameda LLC is a significant user and is required to have an industrial waste
discharge permit from Department of Ecology (DOE) and the City of Moses Lake. Attached is a copy of
proposed Industrial Waste Discharge Permit No. 21 for Titan Data Center/RS Titan-Alameda LLC. This permit
will allow Titan Data Center/RS Titan-Alameda LLC to continue to discharge to the City's Publicly Owned
Treatment Work (POTW) for an additional five (5) years prior to renewal.

4949 Randolph Road Moses Lake, Washington 98837 Effective Date: Expiration Date: INTRODUCTION This wastewater discharge permit is hereby granted by the City of Moses Lake, Washington, referred to as the City, to Titan Data Center/RS Titan-Alameda LLC referred to as the Permittee. This permit is issued in conjunction with the Washington State Department of Ecology Permit No. ST0008105. This permit authorizes Permittee to discharge wastewater from the permittee’s Industrial Facility into the City’s POTW in accordance with the conditions contained within this permit. The permit becomes effective as of the date signed by the City. GENERAL CONDITIONS 1. All discharges and activities authorized herein shall be consistent with the terms and conditions of this permit. The discharge of any pollutant not authorized by this permit shall constitute a violation of the terms and conditions of this permit. Whenever the Permittee refuses to take corrective action or continues a violation, the imposition of civil penalties or termination of this permit may result, or both. Termination of this permit may require disposal of the wastewater in some manner other than into the private sewer or to the City’s POTW, at the expense of the Permittee. 2. Nothing in this permit shall be construed as excusing the Permittee from complying with any current federal, state, or local statutes, ordinances, or regulations. If the State’s Waste Discharge Permit requires more stringent limitations on discharge to the POTW, the State’s discharge permit shall take precedence; and, the requirements contained herein may be revised after written notice from the City. After written notice from the City is received, the Permittee has ten (10) business days to request a hearing before the City Council. The City will provide the Permittee an opportunity for a hearing before the City Council, if requested; and, depending on the magnitude of the changes, the Permittee, City, and DOE may negotiate a compliance schedule under which to make the changes necessary to come into compliance with the more stringent limits. 3. All facility changes that may result in a significant deviation in character of pollutants discharged to the POTW, from that herein specified, shall be reported to the City. Significant adverse deviations in character of pollutants shall be authorized by the City before discharge to the sewer system. No significant change shall be made until plans have been approved by the City, and a new or modified permit has been issued. No new connections, increased flows, or significant changes in wastewater characteristics are permitted that will cause violation of the effluent limitations specified herein. The diversion or bypass of any discharge from any pre-treatment facility utilized by the Permittee to maintain compliance with the terms of this permit is prohibited except where unavoidable to prevent loss of life or severe property damage. The procedure outlined in paragraph four (4) of these General conditions shall be followed in the event of such a diversion or bypass to the City’s POTW.

GENERAL CONDITIONS (continued) 4. In the event the Permittee is unable to comply with any of the conditions of this permit because of a breakdown of equipment or facilities, due to actions on the part of the Permittee, the Permittee shall perform the following actions: a. Immediately stop, contain, and clean up the unauthorized discharge and correct the problem.
b. Immediately notify the City so steps can be taken to prevent damage to the POTW. c. Submit a written report within fifteen (15) business days of occurrence, describing the breakdown, the actual quantity and quality of the resulting waste discharge, corrective action taken, and the steps taken to prevent a recurrence.
d. Pay reasonable costs incurred by the City that are associated with a breakdown, accident, or other cause that can be demonstrated as attributable to such event.
Any permit noncompliance constitutes a violation of chapter 13.05 of the Moses Lake Municipal Code and is grounds for enforcement action in accordance with that code.
5. Compliance with the above requirements does not relieve the Permittee from responsibility to maintain continuous compliance with the conditions of this permit, or the resulting liability for failure to comply.
6. The Permittee shall adequately maintain and efficiently operate all treatment or control facilities or systems installed or used by the Permittee to achieve compliance with the terms and conditions of this permit.
7. After written notice of one of the following, the Permittee has ten (10) business days from the date of the notice to request a
hearing before the City Council. If the City Council determines a violation has occurred, the permit may be amended, suspended, or revoked in whole or in part.
a. Violation of any terms or conditions of this permit.
b. Obtaining this permit by misrepresentation or failure to fully disclose all relevant facts.
c. A change in any condition that requires a permanent reduction or elimination of permanent discharge to the POTW.
8. The Permittee shall allow authorized representatives of the City to perform the following actions, at all reasonable times:
a. Enter that portion of the premises by escort where an effluent source or disposal system is located or where records
are required to be kept under the terms and conditions of this permit.
b. Inspect monitoring equipment or monitoring methods required by this permit.
c. Sample discharge of pollutants.
d. Review test results and test methods.
9. This permit does not constitute authority for discharge into public waters of Washington State. Any such discharge by the Permittee shall be subject to applicable regulations administered by the Department of Ecology. 10. The costs incurred by the City in handling, treating, monitoring, and disposing of the Permittee's wastewater shall be borne
by the Permittee in the rate structure. The City may set forth the various fees in a separate ordinance.
11. The Permittee shall make application for permit renewal at least 180 days prior to the expiration date of the permit. In the event that the City does not respond within the allotted 180 day period, the existing permit shall remain in force until the revised permit is issued.
12. The Permittee shall submit payment of fees associated with this permit as set forth in the fee schedule adopted by the City of Moses Lake. The City may revoke this permit if the permit fees are not paid. Effluent Limits

During the period of this permit, the Permittee is authorized to discharge wastewater to the POTW subject to the specified flow, concentration, and monitoring requirements. Wastewater shall be monitored and discharged to the POTW and shall not exceed the maximum daily flow of 8,600 gallons per day. The effluent limitations for the discharge to the POTW are shown in Table 1: Effluent Limits Outfall 001 (Facility’s Sampling Manhole).
Effluent characteristic limits not listed in this permit are set forth in Chapter 13.05, Wastewater Regulations, City of Moses Lake Municipal Code. In order to meet the effluent limitations, the Permittee shall provide facilities as specified herein. When required, pretreatment and storage facilities shall be designed and operated by the Permittee in a manner such that the wastewater discharge to the POTW complies with the effluent limits. During emergency conditions, or when the effluent does not meet the conditions of this permit, the
Permittee shall divert the flow, collect the wastewater, and re-treat the effluent. If the permit effluent limitations cannot be achieved by the onsite treatment system, the effluent shall be collected and sent off site for disposal in accordance with applicable regulations. Beginning on the issuance date and lasting thru the expiration date of this permit, the Permittee is authorized to discharge wastewater
to the City of Moses Lake POTW subject to the following limitations: Discharge Limits

a. Maximum Daily effluent limit means the highest allowable daily discharge. The daily discharge means the discharge of a pollutant measured during a calendar day. For pollutants with limits expressed in units of mass, calculate the daily discharge as the total mass of the pollutant discharged over the day [lbs/day = (concentration mg/l ) x (flow gpd /1,000,000 ) x 8.34]. For color and pH, the daily discharge is the average measurement of the pollutant over the day. For temperature, no single measurement shall

SURCHARGE SCHEDULE If Maximum Daily Effluent Limits for TSS, BOD5, or FOG from Table 1 are exceeded during the month, a surcharge will be added to that monthly billing statement, and the Permittee will provide a proposal for review by the City of Moses Lake Wastewater Manager to demonstrate how the effluent will be reduced to permitted levels. Reporting and Record Requirements The Permittee shall monitor and report in accordance with the conditions set forth in this permit. Falsification of the information submitted to Ecology or to the City of Moses Lake is a violation of the terms and conditions of this permit. Monitoring Results required by this permit shall be submitted on or before the 15th day of the month following the sampling period. A copy of the Discharge Monitoring Report (DMR) in Ecology “Paris” format will be accepted so long as it is accompanied by the electronic signature form. A notification can be set up through the Ecology “Paris” site to automatically notify City of Moses Lake when the DMR is submitted. This is the preferred method to receive monitoring reports. If you choose to submit monitoring results, please email all reports to the following address wastewater@cityofml.com. Waste Preventative Practices Waste preventive practices shall be used to reduce or eliminate contaminant loading to the POTW. These practices may include, but are not limited to the following: a. The Permittee shall provide access to the monitoring and flow control station for authorized representatives of the City during normal business hours and in the event of an emergency. b. The pretreatment and storage systems shall be maintained continuously in satisfactory and effective condition by the Permittee, and shall be subject to periodic inspection by the City. c. The Permittee shall designate a representative whose responsibilities include the operation and maintenance of the pretreatment and storage facilities, monitoring and permit compliance, and all other aspects of the wastewater discharge. The representative shall be available to meet with the City on any matter related to the wastewater discharge to the POTW. d. The Permittee shall be held liable for all damages directly attributable to its wastewater discharge, exclusive of normal wear and tear. Permittee shall not be jointly and severally liable for the damage caused by any other party, but shall be liable for its pro-ratio share of all liability directly attributable to Permittee’s waste discharge. Liability for damages may include damages to the sewage collection system, pump stations, sewage treatment plant, and degradation of receiving water. e. The following requirements shall apply: In the event that hazardous petroleum or radioactive material reaches the POTW, contact 911 upon discovery. Then immediately notify the Public Works Division by phone or email. Reporting Permit Violations The Permittee shall take the following actions when either the City permit or the State permit conditions are violated:
a. Immediately stop, contain, and cleanup unauthorized discharges; stop the noncompliance; and correct the cause of the problem. b. Contact the City of Moses Lake within 24-hours by phone or E-mail. GLOSSARY City: The City of Moses Lake, a municipal corporation of the State of Washington, or its duly authorized agents or representatives. Composite Sample: A mixture of grab samples collected at the same sampling point at different times, formed either by continuous sampling or by mixing discrete samples. The sample may be time-composite (collected at constant time intervals) or flow-proportional (collected either as a constant volume at time intervals proportional to stream flow); or collected by increasing the volume of each aliquot as the flow increased while maintaining a constant time interval between the aliquots. Constituent: Any of the pollutants or potential pollutants found in the wastewater. Effluent Limits: Flow, concentration, pH, and mass loading limitations for wastewater discharged to the POTW by the Permittee. Monitoring: The program of flow and constituent determination outlined to ensure compliance with the effluent limitations and to define the flow and constituent levels in an expanded scope for the wastewater discharged to the POTW.

Jerome Brotherton requests approval to connect to the City's water and sewer systems to serve a single-family
residence. The property is located outside of the current City Limits and inside the UGA as defined in the most
current Grant County Comprehensive Plan.
The owner will be required to sign an Extraterritorial Agreement (ETA) to connect to City water and sewer. The
ETA must be in place before a permit is issued for connecting to City services. The City currently has multiple
ETA agreements in the immediate area. This property is within 500' of the lake shorelines and connection would
support the reduction of septic system effluent making its way into the lake.
The City will receive water and sewer service fees for the residence long term.

Assessor’s Tax Parcel No. 31-429-1000 1. Parties: The parties to this Agreement are the City of Moses Lake, Washington (herein City), a municipal corporation of the State of Washington, located entirely within Grant County, Washington, and Jerome P Brotherton and Sharon J Brotherton (herein Property Owner).
2. Recitals: 2.1 The City is the owner of a municipal water and sewer system which operates within the City limits and adjacent to real property near Moses Lake, Washington.
2,2 Property Owner desires to receive water and sewer utility service from the City for use upon
Developer's real property located more than one half mile from the corporate limits of the City and located within the City’s Urban Growth Area (UGA). 2.3 The City, pursuant to Resolution No. 3509, requires that all contiguous and non-contiguous
real property which receives water and/or sewer utility services from the City be subject to an agreement which affects the use of the real property served by the City utilities, restricts expansion of City utility services beyond those contracted for, and creates a covenant running with the land.
2.4 Property Owner is fully aware of the restrictions imposed upon Property Owner and Property
Owner's successor(s), heir(s), and assign(s) by City Resolutions No. 3509 and enters into this Agreement freely and voluntarily. 3. Agreement: It is agreed by and between the parties as follows:
3.1 The City will provide the water and/or sewer utility services listed below to Property Owner at
the premises stated, pursuant to the terms of this Agreement.
3.2 The real property to be serviced is located within the City’s UGA and is described per Grant

3.3 This Agreement shall be filed for record in the Office of the Grant County Auditor and shall be in the nature of a covenant running with the premises. It is the intent of Property Owner to have this Agreement, so long as it is in force, to be considered, interpreted, and regarded as a covenant running with the land as to the premises.
3.4 All connections to the City water system and/or sewer system shall comply with the ordinances and rules of the City with respect to the appropriate utility. Any connection to the City’s water and/or sewer system is subject to payment for the utility service of a rate established by the City which shall be subject to adjustment from time to time by the Moses Lake City Council. The availability of the utility authorized by this Agreement is subject to the capacity of the City's water and/or sewer system.
3.5 The water delivered pursuant to this Agreement shall be the same as other water delivered within the City’s system. The City makes no warranty as to such water quantity or quality other than it shall be delivered in accordance with the regulations applicable to city water systems.
3.6 The water service provided by the City is for one service connection to serve a single family
residence. 3.7 The sewer utility service provided by the City is for one service connection to serve a single family residence.
3.8 Property Owner agrees and covenants that all sewer and/or water utility system components
to be built and attached to the City's utility system shall be built to City standards. The standards applied by the City may include requiring construction in excess of that minimally
required to connect the premises to City utilities where such additional construction is consistent with a City plan of service within the area of the premises.
3.9 Property Owner agrees and covenants that the premises will not be used in any manner or for
any purpose inconsistent with or contrary to the land use controls in place as those controls now exist or as they may be from time to time altered, amended, or re-adopted. The Property
Owner acknowledges the premises are subject to development pursuant to regulations administered by Grant County. The Property Owner agrees the City may impose development
conditions greater than those imposed by Grant County, but in no event greater than those imposed for similar development within the City’s limits, as a condition of receiving utility
services under this Agreement. The premises currently are used in a manner consistent with the existing land use controls.
3.10 This Agreement is entered into by the City based on the utility uses identified above and the
land uses identified by the Property Owner for the premises. Property Owner or the successor holder of the fee title to the premises shall be bound by this Agreement and be responsible to
perform under this Agreement. No subsequent leasehold, joint venture, or other tenancy or use agreement shall relieve the Property Owner or the Property Owner’s successor in interest
from performing under this Agreement.
To continue this Agreement in effect and to continue a delivery of the identified utilities, any successor in interest shall execute an acknowledgment of this Agreement, Covenant, and Power of Attorney in a form approved by the City.
3.11 Property Owner shall execute contemporaneously with this Agreement the subjoined Power of Attorney and subjoined Covenant respecting the annexation of the premises by the City.
This Power of Attorney is executed, as is this Agreement, by Property Owner with a full understanding that Property Owner may be waiving and transferring to the City a valuable right as a landowner as respects annexation by the City. Property Owner waives any objection to annexation by the City. Property Owner acknowledges Property Owner has relied

solely upon Property Owner's own legal counsel and fully understands the legal rights Property Owner is or may be surrendering to the City by the execution of this Agreement and the subjoined Covenant and Power of Attorney. 3.12 Property Owner understands the delivery of utility services to these premises so long as they remain outside the corporate limits of the city, is a discretionary act of the City and the
execution of this Agreement and performance hereunder are not intended and shall not be considered as an indication by the City of the intention to become a general provider of utility service beyond the terms of this contract, to these premises or any other lands located outside the corporate limits of Moses Lake. 3.13 Property Owner acknowledges that so long as the premises remain outside the corporate
limits of the City, any or all utility service provided under this Agreement by the City are, or may become subject to, surcharges and/or increased charges in addition to the charges to similar customers located within the corporate limits.
3.14 Property Owner agrees that payment of service charges, surcharge assessments, and/or additional charges required by City ordinances to be paid for the utility services mentioned
above will in no way relieve the premises from Property Owner's share of any future Local Improvement District or Utility Local Improvement District payments which may be assessed to pay all or a portion of the expenses of installing main or mains, together with necessary valves, fire hydrants, pipe fittings and all other appurtenances which may be installed to serve
a district which includes the premises.
3.15 Property Owner agrees that in the event of a sale, gift, transfer, segregation, assignment, or device of Property Owner's fee interest in the premises it will disclose the existence of this
Agreement.
3.16 In the event of a breach of this Agreement by the Property Owner or any successor in interest, this Agreement, and all deliveries of utilities hereunder, shall be subject to termination thirty
(30) days after notice to the Property Owner of the breach if the breach has not been cured.
3.17 In the event the premises is delivered City utilities pursuant to this Agreement and the premises become located outside the City’s UGA, this Agreement shall be deemed to have
been terminated as provided for in the provisions dealing with the term of this Agreement. The period of termination shall begin upon the date the premises become located outside the City’s
UGA unless the parties agree otherwise in writing.
3.18 The permission to obtain City utilities contained in this Agreement shall lapse and become null and void if the premises are not connected to the City’s utility system within two (2) years of
the execution of this Agreement. Except there shall be no limitation for residential properties up to nine (9) lots from the date the commitment is given.
4. Term: This Agreement shall be in effect so long as Property Owner abides, observes, and performs
this Agreement and the premises remains outside the corporate limits of the City of Moses Lake. This Agreement may be terminated by either party giving at least eighteen (18) months written notice
of termination to the other unless a shorter notice is agreed to in writing. Upon annexation of these entire premises into the City of Moses Lake, this Agreement and the subjoined Covenant and Power of Attorney shall terminate and be of no further force or effect.

COVENANT RUNNING WITH THE LAND 1. Basis: The foregoing Extra Territorial Utility Extension Agreement shall be deemed to be a covenant running with the land affecting the entire premises described above. Such Covenant shall be recorded with the Grant County Auditor and become a covenant of record. Such Covenant shall remain in full force and effect for the life of the Extra Territorial Utility Extension Agreement. Any
attempt to cancel, restrict, or modify this Covenant independent of the Extra Territorial Utility Extension Agreement shall terminate said Agreement immediately unless such cancellation, modification, or restriction is agreed to by the Moses Lake City Council. This Covenant shall expire and be of no further force or effect upon the annexation of the entire premises described in the foregoing Extra Territorial Utility Extension Agreement into the City of Moses Lake.
2. Creation: Property Owner, as the owner in fee simple of the above-described premises, hereby creates a covenant running with the land to affect and include the entire described premises. POWER OF ATTORNEY 1. Appointment: Property Owner hereby makes, constitutes, and appoints the City of Moses Lake, Washington Property Owner's true and lawful attorney for Property Owner and in Property Owner's name, place, and stead for the purposes stated herein.
2. Independent Advice: Property Owner has executed this Power of Attorney for the purposes stated after having a full understanding of the implications of the execution of this instrument. This Power of Attorney is also executed after being fully advised by Property Owner’s own counsel as to the power being conveyed to the City of Moses Lake and with a full appreciation and waiver of any rights being abrogated.
3. Purpose: Property Owner appoints the City of Moses Lake as Property Owner's attorney for the purpose of executing any and all documents, petitions, requests, letters, or the like necessary or desirable in the process of the annexation of the premises described in the foregoing Extra Territorial Utility Extension Agreement into the corporate limits of the City of Moses Lake.
4. Termination: This Power of Attorney may be revoked by Property Owner only upon the termination
of the forgoing Extra Territorial Utility Extension Agreement, or upon the consent of the City of Moses Lake's City Council. The continued validity, viability, and existence of this Power of Attorney is a prerequisite of continued utility service delivery to the premises under the terms of the Extra Territorial Utility Extension Agreement by the City of Moses Lake. Termination of this Power of
Attorney by Property Owner shall immediately and automatically terminate the Extra Territorial Utility Extension Agreement between Property Owner and the City of Moses Lake. This Power of Attorney
is deemed revoked automatically upon the annexation of the entire premises described in the foregoing Extra Territorial Utility Extension Agreement into the corporate limits of the City of Moses
Lake.

Empire Well Drilling LLC has completed the Well Rehabilitation Project.
City engineering and operations staff have identified six city wells that require maintenance and/or well
rehabilitation work due to the declining deep aquifer water levels and, in some cases, equipment that is out of
service.
The benefits of completing this project will be to restore the reliability of the wells included in this project to a
level of service that the city requires to meet its potable water supply needs in the near-term.
This project is a high priority for the near-term water supply requirements of the city. However, this project is not
a long-term solution for addressing the declining deep aquifers in the Columbia Basin region.
Upon acceptance, the 60-day lien period for retainage release will begin, as required by Washington State Law.

BILINGUAL PAY INCENTIVE POLICY
I. INTRODUCTION
The City of Moses Lake is committed to providing the highest levels of service to the
community and recognizes the value of employees who can communicate with
customers in languages other than English.
This policy applies to regular full-time and part-time non-bargaining unit employees.
Regular part-time employees may be eligible for a pro-rated benefit. Employees
occupying temporary positions are not eligible for bilingual incentive pay. Represented
employees will be guided by the applicable collective bargaining agreement.
II. EMPLOYEE ELIGIBILITY
Budgetary restraints may limit a department’s ability to authorize all requests for
bilingual incentive pay. Therefore, the city retains the right to test and incentivize
employees based on the needs of the organization. Other eligibility requirements
include:
A. Employees must hold a public facing position and regularly use a second
language in the performance of their essential job functions.
B. Employees who use their bilingual skills on an incidental or occasional basis or for
work done outside of the employee’s essential duties are not eligible for this
benefit.
C. Employees must pass language proficiency testing as selected and
scheduled by Human Resources.
D. Employees who fail language proficiency testing may retest after twelve (12)
months.
E. If an employee moves to a position that does not benefit from language
services, they will no longer be eligible to receive bilingual incentive pay.

III. REQUESTING PROCEDURE FOR BILINGUAL DESIGNAGTION FOR THE POSITION:
A. Departments shall request a bilingual designation by providing written
justification to Human Resources. The justification should describe the need
and the nature and frequency of bilingual duties.
B. Human Resources may designate occupied positions as bilingual, even if the
incumbent does not have bilingual skills.
C. Applicants or incumbents for a bilingual designated position must pass a
bilingual proficiency test to be eligible for bilingual incentive pay. Human
Resources will schedule the employee for testing.
D. Departments may request a bilingual designation to be removed from a position
by providing written justification of requested change.
E. Once an employee passes their proficiency testing and becomes eligible for
bilingual incentive pay, their supervisor will work with Human Resources to
submit a PAF. Upon PAF approval, the employee will begin receiving bilingual
incentive pay effective the first day of the following pay period.
IV. EMPLOYEE RESPONSIBILITIES
A. Employees receiving bilingual incentive pay are expected to primarily provide
language services that are included in their essential functions or assist with
other interpretations provided this does not interfere with their daily work.
Employees should not be providing services that are out of the scope of their
position or experience.
B. Employees receiving bilingual incentive pay who are not certified to provide
written translation services must not translate documents for their department
or others.
C. Employees who have not qualified for bilingual incentive pay should not be
providing interpretations and should instead use the city’s approved language
line.
D. Employees receiving bilingual incentive pay are not required or expected to
provide language services outside of their normal working hours.
V. BILINGUAL INCENTIVE PAY
Employees who are appointed to serve in bi-lingual interpreter status will receive
seventy-five dollars ($75.00) per month.

Spanish speaking customers via phone, and occasionally at the front counter. Written
communication is typically via e-mail responding to licensing and utility billing questions, but also
ĖIJèīŪîôŜϙċĺŘıŜϙÍIJîϙƲƅôŘŜϙťēÍťϙÍŘôϙîŘÍċťôîϙĖIJϙĺƯĖèôϟϙ
Below is a point of view from one member of the Utility department regarding bilingual
communications written on 10/31/24:
I have been here just over a year, not a single day has gone by where my services were not
needed. I am constantly assisting Spanish speaking customers at the counter, over the
phone or via email. As the only Business License Technician for the Finance Division, I
receive many inquiries on how to get a business started in Moses Lake. Most customers who
inquire about a new business, are of Hispanic or Latino descent and have no idea where to

start. I try to provide detailed step by step information on how to navigate this very stressful
process to all my customers. bow imagen those who are not Ʋuent in (nglish and the
disparities these individuals face to become entrepreneurs. For some this may be their
livelihood to provide for their families, so personally I feel compelled to provide guidance in
a language they prefer and comprehend. Recently, there has been an increase in itinerant
merchant or temporary vendors in this community, most are Spanish speaking only. (ither I
or ode (nforcement go out to speak to these vendors to educate them on the process.
Usually after these encounters they call me for additional guidance, and I will follow up with
an email providing links to all resources available to help them. Unfortunately, I don’t see
many of these applicants because they feel it is a lengthy process or because they do not
have access to a computer. In these cases, I have oƯered to assist by meeting with them at
Community Development and utilizing the public computer that is available there.
Since I am also cross trained, I assist Utility Billing with all duties. I’ve had countless
encounters with long time city customers who come in and just pay their bill. When those
same customers Ʊnd out I speak Spanish they are eager to hear me speak in their native
language, and then of course asked to break down their bill for them. I wish I could show you
the excitement most customers express when I let them know I speak Spanish. Some
returning customers will joke and say, “Hey you still work here!” Or “Thank goodness you’re
still here.” Since I’ve moved to the back part of the oƯice, I hear customers come to the
counter asking for me by my name or will ask for the “girl who speaks Spanish, please” and
my colleagues know I am always happy to assist. I continuously educate customers about
the services they are billed for; some customers will then request to make changes to their
garbage cart because they were not aware of the options we oƯer. I also take a great time
talking about the water conservation implementation and how they are being billed for the
water consumption. Another reason why I spend so much time with (SL customers is due to
the lack of bilingual materials we oƯer; we have slowly implemented more Spanish
translated material, and I can assure you customers are excited to have these items. I am
not just bilingual, but also biliterate, which has assisted my division in translating written
disputes from customers. Most customers leave here with a better understanding of what
services they pay month to month and knowing what type of changes they can implement to
possibly lower their bill and are appreciative of the time I spent educating them on this
matter. I personally feel like customer service experience has improved for our (SL
customers because in the past when they called, they had to wait minutes to get a
translating service on a 3-way call, sometimes for the simplest questions. I feel like me
being able to take over a call or simply come to the counter has saved Utilities department
so much time. I also noticed people are less aggressive or upset when they have a
complaint and can express themselves in their native language because I can understand
them and can answer their questions directly verses having to wait for a translator to explain
their complaints.
Being bilingual in my division is super important for the best customer service experience
and being physically in oƯice to assist face to face is ultimately the best way to provide
these services.

Hello Doug-
We are unable to move the show to July 4th. We do not have the Pyro team to accomplish this move in 2025 and
have been turning down all requests for a July 4 show at this point.
For 2025 do you envision the same location? If so, I know it was a ton of work for Bill and his crew with the floats.
As we move forward with a plan for the 2025 fireworks display, let me know if you want to do the same location or
find a land-based site?
For 2025 I would suggest a budget of $28,750, a 4.5% increase over 2024, to cover the cost increases in insurance, and
fireworks. This will maintain the quality, intensity, and length of the show.
As soon as you have an approved budget, we can confirm the show in our system so we can provide a proposal and
contract. This will reserve the product and begin to work on the logisƟcs of the show for 2025.
