AN ORDINANCE VACATING THE ALLEY/RIGHT-OF-
WAY LOCATED BETWEEN PARCELS 101315000 &
101319000.
WHEREAS, the City of Moses Lake has received a petition requesting the vacation of right of
way of unimproved alleyway in conjunction with a boundary line adjustment-lot consolidation
completed on 01/03/2023, and
WHEREAS, the City Council has adopted a resolution setting a public hearing to consider the
petition, fixing the date and time as November 12, 2024, at 6:30 pm, in the Council Chambers, and
WHEREAS RCW 35.79.030 authorizes the city to vacate any street, or alley, or any part thereof,
and that the city be compensated for full appraised value of public right-of-way that has been
dedicated for more than twenty-five years, and
WHEREAS the alley/right-of-way was dedicated to the public in 1952 via the Lewis & Elliott
Addition.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. The following described public right-of-way shall be vacated:
That portion of the city alley/right of way described as vacant alley located directly to the south
of the parent parcel (101315000), 20 ft by 140 ft.
The north half of Alley abutting Lot 5 Lewis & Elliott Addition, and the South half of Alley
abutting Lot 12 Lewis & Elliott Addition according to the plat recorded in volume 5 of plats at
page 27.
Containing 2,800 sf (20’ x 140’)
Section 2. The City shall be compensated for the full appraisal price of the vacated property. The
vacation shall not become effective until the required compensation is received by the City.
Section 3. Severability. If any section of the ordinance is found to be unconstitutional or invalid as
written or as applied to any particular person or circumstances, no other section of the ordinance shall
be deemed to be invalid, but rather, should be deemed to have been enacted independently and
without regard to the section affected.

Section 4. Effective Dave. This ordinance shall take effect and be in force five (5) days after its
passage and publication of its summary as provided by law.
ADOPTED by the City Council of the City of Moses Lake, Washington and signed by its Mayor
on November 12, 2024.
