4006 RJB SubdivisionRESOLUTION NO. 4006 A RESOLUTION ALLOWING RJB SHORT SUBDIVISION TO DEFER REQUIRED PUBLIC INFRASTRUCTURE CONNECTION AND IMPROVEMENTS Recitals: 1. City of Moses Lake Municipal Code (MLMC) 17.33.010 allows for Waivers, Deferrals, and Deviations after a resolution has been duly passed by the City Council. 2. On July 9, 2024, Columbia NW Engineering on behalf of RJB submitted a request for approval of a Preliminary Short Subdivision, “RJB Short Plat.” This application is vested under codes cited herein. 3. The Preliminary Short Subdivision included a request for a Subdivision Waiver, Deferral and/or Deviation for RJB Preliminary Short Subdivision for the following: “Deferral of Requirement to build three-quarter width improvements to South Frontage Road until such a time as this area is further subdivided / and or developed. This segment of South Frontage Road as currently constructed is adequate to serve the vicinity with no decrease in existing levels of service resulting from this subdivision.” “Deviation of requirement to construct and connect sanitary sewer improvements. The site would continue to use the existing septic system until a time if/when sanitary sewer is developed along South Frontage Road. A 3” Pressure Effluent Force Main is at the intersection of Sage Rd and Idaho Rd. This main would be required to be extended approximately 4,400 feet +/- to serve the project location at the developer’s expense.” “Deviation of requirement to construct and connect city water system and fire hydrant improvements. The site would continue to use the existing well until a time if/when the city water system is developed along South Frontage Road. An existing 12” main is stubbed out at the intersection of Idaho Road and Sage Road. This main would need to be extended approximately 4,400’ +/- to serve any development at the developer’s expense. The developer would like to propose fire-flow storage on-site in place of fire hydrant(s).” 4. The subject property is identified as Parcel No. 110065206. 5. As allowed by MLMC 17.33.010 Waivers, Deferrals, and Deviations “Where, because of the size of the tract to be subdivided, its topography, the condition or nature of adjoining areas, or the existing or unusual physical conditions, the strict compliance with the provisions of this title would cause an unusual and unnecessary hardship on the subdivider, the designated approving body may waive, defer, or deviate from the requirements set forth in this title.” 6. The City Council finds that the request is appropriate for deferral due to the location and distance from existing services. In that the distance is too great to reasonably connect. 7. The City Council finds that the subject property location in relation to existing infrastructure is an existing physical condition that the applicant cannot resolve. 8. The City Council finds that the extension of utilities would not loop into other existing or potential future utilities. An extension would be considered a “dead end” as to the fact that the property is not surrounded by, nor adjacent to, the Urban Growth Area nor other lands within the city limits. The City Council finds that an approval will include a condition (see City Engineer comment) to ensure extension and connection as determined by the City. Resolved: 1. The “RJB Short Plat” request for deferral City of Moses Lake public infrastructure is hereby granted subject to the City of Moses Lake Engineer comments which are hereby conditions of deferral. 2. An annotation shall be placed on the face of the RJB Short Subdivision plat map with the Auditory Filing Number of the signed Council Approved Covenant. In addition to such annotation, a statement that at the time a building permit is applied for any structure within this subdivision, the building permit will be issued upon confirmation by the City of Moses Lake Fire Chief that necessary engineered fire protection system and associated infrastructure is in place to provide fire protection, which may include, but not limited to: fire hydrants, fire flow, and sprinkler systems, as well as potable water in compliance with the Covenant.
